I would like a reply from a Pink. I have a question on this type of shipping insurance scenario. Who pays if the buyer REFUSES to cooperate with a shipping INSURANCE claim?

Seller ships breakables and buys insurance from the Post Office or from a 3rd party insurance carrier. Item costs $150.00

Seller informs buyer in the Shipping Notice that their shipment is covered by insurance.

Well...the box is smashed by the post office during shipping and most items are broken on the inside.

Seller sends directions to the buyer on filling out insurance form.

Seller tells buyer they will send full refund the buyer right after the buyer shows the box to the post office for the insurance claim. Which would be tomorrow if the buyer takes the box to the PO tomorrow.

The buyer sends an ebay message to the seller... stating they refuse to cooperate with an insurance claim. Or the buyer says they don't have time to do an insurance claim... and they don't have time to take a picture either. Or they give other excuses in the email indicating they are not going to cooperate with an insurance claim. They tell the seller they are shipping back the damaged merchandise and the seller can do the insurance claim.

As you know... the buyer's post office requires inspection to process an insurance claim and will most likely take the box of merchandise too. A seller cannot file an insurance claim if the item is shipped back before postal inspection.

The PO requires an inspection of the box. And if a 3rd party insurance is used, then they will require photos of the original shipping box, packing material and of the item.

So the seller explains to the buyer that the post office will need to see the item to get the insurance etc. Seller again tells buyer they will refund right after the buyer shows the PO the smashed box.

But the buyer sends back the box anyway. The buyer takes the time to ship in another box but will not take the time to take the box to show at the PO for an insurance claim.

The buyer said he has no time or does not want to be bothered with insurance. Buyer demands refund.

The seller paid for insurance out of her own pocket for this shipment but will lose the insurance if the buyer refuses to cooperate with the terms of the shipping insurance policy.

The buyer next files a SNAD against the seller for the $150.00 item. Buyer puts a DC number in the claim for shipping item back to seller.

Seller shows proof to ebay... of the receipt for the insurance purchase... and shows ebay... the message where the buyer refused to cooperate with the insurance claim.

The seller bought insurance on the $150.00 item but cannot make a claim... because the buyer refused to show the post office the broken item. So does the seller lose the value of the item, plus shipping, plus ebay fees too?

Who wins the SNAD claim? The seller or the buyer?

I did everything right per ebay rules and even paid for insurance out of my own pocket. Will ebay allow the buyer to leave negative feedback and give me loss of status too?

I am a small seller and need to know what ebay expects me to do... so I don't take a loss out of my pocket... or a loss of ebay status.

Why would a buyer claim that they won't cooperate with an insurance claim, but would ship the item back to the seller, which involves not only a comparable trip to the PO but also repacking and an outlay for postage?

Did you know that the USPS now has an online process for insurance claims, which can be initiated by either party? The recipient is supposed to keep the item and all packaging in case their local PO wants to inspect it as part of the investigation.

AFAIK, purchase of insurance (or not) is not factored into SNAD claims at all.

You don't have to go to the post office to ship an item... I can do it from my house and it's about 10 miles to my nearest post office... valid question!

A buyer did that to me. I panicked and gave him a full refund including return shipping trying to safeguard my feedback. There was several items missing from the set and I suspected the buyer kept those items for his own collection. The PO wanted to see the box and I lost the claim. He said it was easier to give the box to a local UPS shop for mailing next door to where he works. That was a big loss for me!

If a shipping insurance claim must be filed, then it is the seller’s responsibility to have the item picked up at the buyer’s address by the shipping service or make other arrangements with the buyer. Once this is done, the seller should refund the buyer and work with the shipping insurance carrier to recover their funds. Throughout this process, the seller should be sure to communicate via eBay’s My Messages platform to ensure there is a record of the communication.

If the buyer is not willing to cooperate with an insurance claim please make sure to document this in the resolution center before the claim is reviewed by eBay for a decision.

So you are here ADMITTING that eBay can confirm a buyer and seller are communicating via the message system?

You have just CLOSED the claim for buyer complaints. You have just PROVEN that eBay DOES have a way to track communications from a buyer, and whether they have bothered. You have just EXPOSED that eBay can indeed FORCE buyers to prove that they have communicated with the seller BEFORE filing a claim.

And you have stated that it can be done in the EXACT way I suggested!
