eBay and eBay Partner Network lawsuit (2009)

I thought you may find this interesting. A lawsuit is being filed against eBay and eBay Partner Network for breach of contract, deceptive and unfair business practices. The following was pulled from a blog:

"eBay had solicited individuals to join its eBay affiliate network via Commission Junction where eBay would then pay a commission for buyer referrals to its eBay website. eBay released Commission Junction and initiated its own administrative website of its affiliate program called eBay Partner Network. eBay then locked multiple individuals out of its affiliate network after they spent a considerable amount of time and money to promote eBay. For example, I purchased about 50 domain names, hosting accounts and created about 50 eBay referral websites that were sending buyers to eBay. eBay failed to provide notice or a reason why it breached its contract with these individuals. eBay then failed to pay owed commissions on the buyer referrals nor did it compensate the individuals for their time and money. When eBay affiliate members asked eBay for a reason why eBay refused to grant them access to the eBay Partner Network, eBay refused to give them a reason.

The lawsuit against eBay will be filed within California and it will be based on a breach of contract, deceptive and unfair business practices.

The comments section above contains a copy of an email sent to affiliate members from eBay refusing to grant them access to the eBay Partner Network and failing to give them a reason why it refused them access.

I’d like to inform you that eBay Partner Network (and each eBay Advertiser) may use different criteria to accept affiliates. In some cases these rules may differ from Commission Junction. This means that we may not accept publishers who were previously registered, and vice versa.
We have re-evaluated your application. Unfortunately eBay Partner Network will not accept your application at this time.
I regret to say that eBay Partner Network can not disclose the exact reasons why applications are accepted or rejected. However we do re-evaluated our criteria on a regular basis. If you’re still interested in participating in a few months, please feel free to try registering again.
I realise this may not be the answer you’d hoped for. Thank you for your patience and understanding.

This is an old story, and it's not related to buying and selling on ebay. It has to do with the affiliate program in which people like me earn $$ by promoting eBay on our websites, blogs, etc.

There have been many folks who've tried to cheat the affiliate network and have been caught. They act as if they had no clue about what they were doing, stuff that is not ok under ebay policy. Even if they were clueless, affiliates have a responsibility for following the rules. As with buying/selling on ebay - ignorance is not a valid reason for breaking the rules.

It's been a l-o-n-g time since eBay ran its affiliate program through Commission Junction. People would do well to check the dates of events and other information before posting them and getting folks riled up for no good reason.....

For most things like this, it's pretty simple: are you involved with eBay's affiliate program? If yes, find out more. If no, don't worry about it. :)

The folks who are/were the most upset were those who were sending tons of browsers to eBay... but not many buyers. So the program was revamped to pay out based on the performance of the referred shopper. If they buy, you earn. If they only window-shop, you don't.

It should mean better buyers.... or at least shoppers more interested in buying and less in just looking around. :)
