Non-paying bidders

Dear fellow confused Ebay seller, I have a better one for you to chew on....I have been a member for eight years. I'm not a power seller, I just like to play around with old Cadillacs. I had a 1976 Eldorado Convertible on Ebay about three weeks ago. No reserve starting bid was $6,080. In my listing I clearly detailed that FIRST BID OWNS and that a $500 deposit was REQUIRED with 48 hrs and that payment in full MUST be made within seven (7) days. When the auction was over I sent the high "bidder" a note of congratulations and an invoice for the $500 deposit. Get this his reply was "I don't send deposits, I'll TRY to get out to see it in three weeks, IF I can, & IF I like it I'll buy it."
I started to investigate what I had to do right away. According to Ebay I had to wait seven days before I could file a non-paying buyer (should be bidder) case. Went through all that exicting process, following all of Ebays requirements. After the non-paying bidder case was closed, Bidder left NEGATIVE FEEDBACK for me. This took my perfect 100% (16) positive feedback rating to 75%. As I said I don't do it alot.
Then I contacted Ebay about the unjustified negative feedback, Ebays reply "BUYERS are allowed to leave negative feedback" No matter where I send Ebay e-mail, no matter how many times I explain Ebay keeps refering to him as "Buyer" So yesterday I notified high bidder who did not follow the terms of the auction that I will be suing him here in Ohio for breach of contract if he does not remove the negative feedback. What I find most confusing is that Ebay seems to protect people like the non-paying bidder instead of those of us who follow the rules.
Would you look at and consider buying a classic Cadillac from someone with a feedback rating of 75%? I wouldn't.
Griff tried to help but, the same thing keeps happening, BUYER CAN DO WHAT HE WANTS, EVEN THOUGH HE BOUGHT NOTHING!!!!!!!!

BUYERS CAN DO NO WRONG AND SELLERS CAN DO NOTHING RIGHT THE WAY THINGS ARE

Don't know don't care. I hit the buy it now button. My wife and I packed a bag and drove 6 hours to Kentucky. An houtr after buying. With CASH in hand less than 24 hours later, paid for the car and drove it home. The way it should be. One was in Kentucky, the other in WI. When I bought, I fixed several things, and resold. It's called capitalizum. When I saw the listing that I used buy it now on I knew it was worth more than selling price. Worked out okay, sold for $6,500 second time, already have cash and the car is on it's way to Vienna Austria. And yes, electronic funds transferr not a cashiers check from nigeria. Problem is the feedback and Ebays failure to do anything about it. Just curious, do you have a proble with buying something, repairing some issues and reselling?

Why do you ask?
I was only stating an obvious fact jack.

Its a mind over matter thing.I don't mind and it don't matter to me.

Your Austrian buyer will be "styling" driving around in that Love Boat.

Lotsa extra dating room in that car for sure.
Tilt/Telescopic, power seats and NO trans tunnel on the floor and stand up room when the top is down:^O

First off I'm not sure what is considered obscene language these days but calling the bidder an "ASSWIPE" in your feedback to him might be grounds for getting your feedback to HIM removed.

Second, I'd never have a listing starting at $6K where "FIRST BID OWNS" it. You won't get any bids until the end and by then it's too late to weed out the flakes and scammers. Besides the fact that listings like that turn many people off, you may only get 1 or 2 bids while in a reserve listing starting at $1000 you may get 20 bidders, some of whom you could have contacted when the winning bidder backed out.

Third, you could have made the listing such that immediate deposit through Paypal is required. Then, at least, you get a deposit.

OP if the buyer request it than they can get ALL your feedback removed.

Those faulse positives are not allowed and neither is the potty mouth talk.

bryan,

After you filed the UPI with EBay, and had to wait 7 days, did the buyer ever respond and make comment to your claim?

If they never responded, they are not allowed to leave feedback.

Good to see someone who can stay focused. This is a quote from Ebay's "feedback Resolution Removal Section".....

When the buyer's communication within the Resolution Center undermines the purpose of the unpaid item process and the eBay Feedback system.

His response to me in the "resolution center" was basically I don't care about the terms of the auction, I do not send deposits, sell the car to someone else" Sounds to me like that "UNDERMINES THE RESOLUTION PROCESS" yet the, and I use the term very loosely "customer service" people at Ebay can't seem to understand they guy is not a BUYER, he was a high bidder for whom the rules don't apply. His negative feedback was and is completely unjustified and damages my reputation, Ebay has all the cannons pointed at me kinda like the person two or three reply's back. If this happed to you would you be happy?
I keep hoping someone with a brain at Ebay will read this or accidentally see one of my many emails to their "NON-PAYING BIDDER PROTECTION DEPARTMENT"

Anyone ever FIX this kind of situation please let me know.

lol....when Cadillacs fly

I understand your frustrations and you came to the right place. This is where all come who have been wronged by ebay or other ebayers.
I expect ebay will remove your naughty pos feedback and I think they can suspend you from selling with that low 75% fb score.

Theres no fixing this, you just have to live with it and go on. If you plan on selling more cars on ebay you may need to see a doctor first.

IMO EBAY NEEDS TO ADDRESS THIS PROBLEM NOW NOT LATER

IMO EBAY NEEDS TO DO AWAY WITH THEIR SILLY FEEDBACK SYSTEM

IMO WHEN A VEHICLE SELLS THE REQUIRED DEPOSIT NEEDS TO BE TAKEN OUT OF THE BUYERS ACCOUNT AND DEPOSITED IN THE SELLERS ACCOUNT RIGHT THEN NOT WEEK OR WEEKS LATER

IF ITS NOT FAIR FOR THE SELLER TO LEAVE NEGATIVE FEEDBACK WHY IN THE WORLD IS IT RIGHT FOR THE BUYER TO DO SO

SOUNDS LIKE TO ME ITS ONE SIDED

There is NO doubt that the feedback system since it has been changed is just wrong period.

There seems to be more chance that your feedback left for NPB will be removed?

Unless Bart Simpson is the moderator on that one?
Low Life Scum Sucker, Asswipe and Butt Scratch will probably get removed.

I don't even know if you could do a mutual feedback withdrawl on those now?

I woulda just left: no payment received and transaction incompleted.

Then again thats a false positive?

On the bright side I guess?
The car sold and for $500 more and thats about as positive as I think it will get for ya;)

Heck if a seasoned auto dealer here can't get a negative removed? Its rather unlikely that yours will get removed also.

The feedback system is just plain wrong period.

I have already spoken to an attorney, because Ebay says they will remove negative feedback with a court order, We'll see if it works that way. Just for the record bidder is a low life. He should never be allowed to bid again.

If he would have come and seen the car and left negative feedback because the car was junk it would be a whole other story. The car is beautiful and the gentelman from another country who paid the deposit within an hour and paid in full in two days is going to love her.

At least I know I'm not the only victom of this nightmare system which protects the cockroaches.

Oh yea, statements like that will really help your case with Ebay to get your -FB removed. DUH. And FYI, Ebay reps DO read these messages boards.
