Hello, and thank all of you for using your time to save all of us, hours of research. I am enrolled as a member of the Lumbee Indians, which in 1956 under The Lumbee Act, we were recognized as having Native American origins, but withheld recognition as a tribe. My question is....under the Indian Arts and Crafts Act of 1990, can I list the beads that I make myself as Native American Origin beads or Native American Heritage beads? Again, thank you for the time and advice that you give for answering our questions.

Hello, and thank all of you for using your time to save all of us, hours of research. Don't know if this answers your question:

Native American crafts
Sellers need to be very specific and comply with federal law when describing their post 1935 art, or craft, as a Native American piece. Under the Indian Arts and Crafts Act, all arts or craftwork offered for sale as American Indian or Alaska Native must be made by an enrolled member of a state or federally recognized Indian tribe or by an individual certified as an Indian artisan by the governing body of an Indian tribe. If you're representing your arts and crafts related item as an "American Indian" or "Alaska Native" piece, you are required to include the name of the artisan who made the item, as well as the name of the tribe of which he or she is a member. If the artisan is not a member of a tribe, but is certified by the governing body of a tribe, this information must be included in the listing.

If the artisan name and tribe or certifying tribe in unknown, the piece may not be described as “Native American”, “American Indian”, or “Alaska Native”. These items are also not allowed to be listed in the categories designed for authentic arts and crafts.

Native American Reproductions

Failure to comply with the above text reference or category selection will result in the termination of the listing. This policy applies to all Native American items, including crafts and artifacts.

Thank you Lexy143, I guess the word Tribe in the Act of 1990 would be the answer, since we are not recognized as a tribe. Thank you again for your time, and answer. By the way, I love your cat.

Is your tribe recognized by North Carolina as being a tribe? It looks to me that N.C. recognizes you as a tribe, but the Feds don't. You don't have to have Federal recognition. The law says Federal or State. So if the state recognizes you as a tribe, you're in. From the Dept. of the Interior website: The Indian Arts and Crafts Act of 1990 "Under the Act, an Indian is defined as a member of any federally or State recognized Indian Tribe, or an individual certified as an Indian artisan by an Indian Tribe."

OMG, I love you guys, OWL4343, you are so conscientious, I bypassed the State in the Act of 1990 entirely, and only focused on the federal recognition. I can never thank you enough for pointing this out, but sincerely, Thank You very much.

Just be ready to provide confirmation of your tribe's status with the state should eBay get their knickers in a twist. You may have a hard row to hoe; you will be competing against unscrupulous people who think nothing of listing Chinese knockoffs as authentic NA-produced, and will use cheap goods to undercut the competition.

If you list your item in a Native American craft category, all you have to state is the name of the artisan/maker and the tribe - adding "as recognized by the state of..." is a bonus and fulfills eBays policy requirement. If anyone is going to pursue a request for proof, that would be the IACB.
