EBAY CHEATS SELLERS & WILL RULE I N THE BUYERS FAVOR 100% OF THE TIME. I SOLD A RING ON EBAY & MY LISTING WAS EXACTLY DESCRIBED IN EVERY DETAIL & I ALSO HAVE A 7 DAY RETURN POLICY. BUYER HAD RING FOR 8 DAYS & FILED A CLAIM SAYING "ITEM NOT AS DESCRIBED" THROUGH EBAY BUYER PROTECTION. EBAY ALLOWED BUYER TO RETURN RING & GAVE HER ALL OF HER MONEY BACK INCLUDING THE MONEY SHE SPENT TO HAVE RING RESIZED EVEN THOUGH I COULD PROVE MY ITEM WAS EXACACTLY & PRECISELY DESCRIBED IN MY LISTING BY HAVING A REPORT DONE BY A LICENSED GEMOLOGIST AND EBAY STILL ALLOWED BUYER TO RETURN RING WITH NO COST TO BUYER EVEN THOUGH RING IS EXACTLY DESCRIBED IN LISTING & EVEN AFTER BUYER HAD RING RESIZED COSTING ME $40 & AFTER TELLING HER THE ITEM COULD NOT BE RETURNED AFTER HER MODIFYING THE RING TO HER SPECIFICATIONS. Totally agree. Ebay and Paypal ALWAYS side with the buyer. Here's what happened to me today. This buyer picked up the item # 400183868084 from my house. She was able to inspect the condition to make sure it matched the description of the item which was listed as used and had broken pieces. She took the items home. She emailed me thru the eBay message system stating that she broke the item while cleaning it and was going to state that it was significantly not as described ( being dusty) if I didn't issue her a refund. I explained that I was not able to accept a return of the item since she stated she BROKE the item. I did my homework and contacted both paypal and ebay. Both parties advised me that I did nothing wrong and to recommend that the buyer file a dispute. I asked how that dispute process works with both Paypal AND eBay. BOTH parites stated that if the case was decided in MY favor, she would be refused a refund and get to keep the item. If the case was decided in HER favor she would have to return the item to me, after I receive the item, I would have to issue her a full refund. She filed a dispute with eBay this morning. I responded that I was not able to issue a refund for an item she broke once she got it to her home and an eBay automated system issued her a full refund AND she gets to keep the item, AND she is allowed to leave me negative feedback. How is that fair to a seller that did absolutely nothing wrong?? The message that is being sent to the buyer is that they can buy whatever they want, file a claim, get a full refund, get to keep the perfectly good item, and get to leave negative feedback. Very very unacceptable. I'm very disappointed in both ebay and paypal. What I was advised would happed both eBay and Paypal is NOT what happened. I would very much like to discuss with with someone at eBay and Paypal that is authorized to make changes in a broken system.

I'm actually raising my prices due to the "New" policy. My problem is the contact system isn't clear. I've had 4 newbie buyers this year not contact me and file a case, thinking that this is how the process works. I swear that 5% of my buyers need their hands held every step of the way and 1% are plain illiterate. I'm going to lose my top seller status at the end of this month to 4 cases out of 760 sales, each one resolved, and two resolved by the buyer acutally looking at packaging tracking. Two were items not as described, yet my auctions are clear on what years the parts go into. Trying to cram an 2001 part into a 2005 car won't work. Yet they count against me. I'm being punished because 4 of my customers either can't read a part code or can't click a shipping link. I have had all my cases resolved in my favor, yet DING. Thanks Ebay! Whatever loss I take in increased ebay fees will directly go to my new pricing. I'm going to list the reason right in the auction, along with the reason I only ship internationally with the most expensive, trackable option allowed. Nobody rides for free.

I agree. I sold an iphone on ebay and paypal said I am not at fault. I called ebay and they said that I listed the tethered jailbreak very clearly. When I checked my email later, the buyer won, left me negative feedback and worst of all I now have to eat up shipping and fees. BS!!!

I absolutely agree! Buyers abuse the eBay Buyer Protection on a regular basis and sellers have NO WAY of leaving negative feedback to warn other sellers. Today, this buyer opened a buyer protection case after returning merchandise that wasn't even close to what I sent her and got a refund because she provided tracking information and eBay tracked that the package was returned to me. HOW BS!!!

Tell me what's up with this - The policies eBay has toward the Seller obviosly stink. I have been an eBay seller since January 1999. Not only are their fees constantly increasing to sellers (Now, we have to pay fees on our shipping too! This is a cost of doing business - not a profit area !!!), but thier policies towards us as Sellers are not very favorable - and we are the ones who pay them - they make their money off of us, our sales - doesn't seem quite fair. I hope eBay reads these posts and resolves this major issue more in favor of the Seller before any legal action ensues... that would be the honorable thing to do. We do business by the Golden Rule... "Do unto others as you would have them do unto you" - This is why we have a 100% Positive Feedback for 12 years - NOT AN EASY FEAT!

Same sad story here. Twelve years of perfect feedback and now one lousy, cheating buyer (who i had to file a non-paying bidder action on!) gets away with theft using the exact same scam described again and again. Ebay clearly doesn't care about this process or US as part of their business model. They've chosen to be a marketplace for Chinese mass sellers (and good for them) and obviously no longer need/want the individual seller. This action was the last straw for me, I'll only use well known commercial auction houses and will close my ebay account. I was foolish enough to document and VIDEO my item before shipping because I expected a scam after filing the 'non-payer' action against the scammer. Don't bother. Resolution never asked for the video url or the item numbers of the other sellers she'd scammed who could only leave "warnings" within their 'positive' feedback (as I now have). Siding with the buyer is automatic. Ebay used to be great, but i pity anyone thinking they have a chance selling on it now. Unless you sell inexpensive goods and can absorb the scam losses, you will be burned and you have been warned.

BEEN A SELLER FOR OVER 11 YEARS... I THINK WE HAD SOME RIGHTS BACK THEN, NOW WE HAVE NO RIGHTS... WE SELL NEW ITEMS,.. BUT YOU HAVE THOSE NEW BUYERS WITH "ZERO KNOWLEDGE" WHO BUY AND HAVE NO CLUE TO THE RULES AND REGULATIONS OF EBAY... I HAD A NEW BUYER WHO SIGNED ON EBAY SAME DAY THAT BOUGHT FROM ME, THEN HALF HOUR LATER, DECIDED THAT THEY BOUGHT IT BY MISTAKE.. AND REQUESTED A CANCELLATION, I SAID, NO PROBLEM.. FILED A CANCELLATION DISPUTE WITH THE BUYER.. THEY BUYER WENT A HEAD AND OPEN A DISPUTE WITH EBAY AND PAYPAL "ITEM NOT RECEIVED" MORONS, THEY JUST BOUGHT THE ITEM HALF HOUR AGO... I have been selling since 1998 and I agree 100% with you. Here is another issue there is No Penalties for Buyers who do not pay. I have 3-4 NON Paying Bidders a week, Not because they dont want it because thet bid on 3-4 of the same item and the cheapest one they pay for, but there is no panalty. So I file a non paying bidder alert and get my fees back, then I have to go through all the crap again to re-list while they walk away. As for ebay saying Oh well 3 non paying alerts and we susepnd them, yeah and they have 3-4 other accounts on ebay they can buy from. Why did they change thee policy of feedback and why not just change it all, either positive fo nothing for sellers to ?

I am rather new to selling on eBay and I have just experienced a total bias against sellers. The only other items I have sold in the past were ballet tickets (no problem) and a treadmill that was picked up by a local buyer (again, no problem). I recently placed 8 items for sale on eBay. I was spring-cleaning my house and these were household items in excellent condition that I no longer had a use for. I did have some trepidation because I thought that I might become susceptible to buyers who knew their way around the system and I really didn't but I decided to try it anyway. All of the buyers were honest wonderful people except for one. She definitely knew the ropes but at the time I didn't. What a life lesson. She delayed the shipment (I thought maybe because she had a post office box Yeah right!) She sent me horrific emails, claiming that the item was so damaged that it was junk. I was really puzzled by this because it was in new condition and packed so carefully that there was no way it could be damaged (I must have added another $5 to $10 in shipping charges just with the packing materials). She claimed that the item was not as described, took advantage of the free shipping, and took me for a ride. I knew that she was exaggerating, untruthful, and working the system. I sent the case to eBay's Resolution Center since I really couldn't deal with her. (It was only $25 but I was being shaken down). What a mistake. Resolution Center - what a euphemism. In less than 5minutes they decided in favor of the Buyer From Hell. Actually at that point I had to laugh at myself. Good one. How naive or beyond stupid had I been? Then, the Buyer From Hell proceeded to trash me on feedback. All my other feedback was great. Then I discovered that I was barred from providing feedback on her. Beautiful. I paid my eBay fees immediately so that I could close my account. Still could not get away from this awful experience. Oh no ! you cannot close your account for 30 days after you've paid your balance. Not tortured enough. So now I wait 30 days. Thanks eBay for a great selling experience.

Hi sienna1927, I feel your pain! I have only recently started selling a few bits and bobs on here, just to make a little bit of extra cash, because I'm not earning much these days, and times are hard for everyone!! I have had a few pleasant selling transactions, but I have had 2 recently that have driven me to the point of insanity!! One was a situation where I sold a faulty Playstation 3 console, I was selling it for a friend, and he told me that the Blu ray drive was faulty. So I decided to plug it in, just to make sure. I was able to turn the console one, but it wouldn't read any Blu ray discs, or any disc whatsoever. I explained this in the description, and also explained that I will not be accepting any returns, as the console is SOLD AS FAULTY!! Someone bought the console, and after I received the payment, (through paypal, may I add) I packaged it up, covered it in bubble wrap, boxed it, and sent it by royal mail first class recorded delivery. The buyer received it the next day, telling me that the console was damaged, and emailed me a picture. The picture showed that the box was damaged, and there was a big plastic chunk taken out of the Playstation console, right next to the power supply! If that was me, and I saw the damaged box, I would have refused delivery. (I have done a few times previously.) But he accepted it, and asked me for a refund when he saw that there was damage. I advised him to contact the royal mail, and make a claim for compensation through them, and I will send the proof of postage to him. That wasn't good enough!! He wanted a partial refund from me, AND the proof of postage too!! I respectfully declined that, and be ended up opening a case through eBay, as 'item not as described'. I spoke to ebay reps over the phone various times, and explained the situation, and the advised me to let the case escalate after 10 days, and they will most likely favour me! Boy, was I wrong!!! He ended up winning, I have now had the money taken from me, (which has been on hold in my paypal account for the last 2 weeks anyway!!!) Now I am hoping he doesn't send me back a box full of bricks!! The second troublesome buyer I have had recently is where I have sold a working xbox 360 console, which showed a picture of the console fully working on the listing, and I also advised I will not be accepting any returns on the listing, as the console is fully operational. (bearing in mind that I have tested this console on a 4 hour gaming session with it in a not very well ventilated area, just to make sure it won't play up when it has been sold!!) I ended selling it for a VERY low price for a working console, I have seen faulty consoles sell for higher!! Anyway, I packaged it up well, and sent it off. The buyer received it, and after using the console, he left me positive feedback, saying how glad his son is to have a working console again! Now however, 4 days after the positive feedback, the buyer has sent me a message saying that the console is now not working. I apologised to him, and said that I do not offer any returns, (as stated in my listing) as the console was working, and even he was using the console for a while. Needless to say, he was quite angry, and demanded me to accept a return. I have over 200 positive feedback, and he has 4, one of them was from ANOTHER xbox 360 console bought from someone else. I advised him that I cannot be 100% sure that it is my console that is faulty, and asked if he could send me a video of the console not working, and asked for the camera to move to the back and show the serial number of the faulty console in the same video. (I take the serial numbers of anything I sell, just in case) He declined, and has now opened a case as 'item not as described!' I would like to know if it is actually my console, because if it is, I would happily swap it for a other console, as he has only had it 5 days, but he won't prove to me that it IS my console. I give up selling on here!! There is NO SELLER PROTECTION AT ALL!! Anyway, sorry about my lengthy post!! Dan

I'm glad to know I'm not the only one so dissatisfied with eBay! I'm a small seller, with low priced items, mostly glassware. I, too, am disabled and my sales buy my groceries. Now, with the fee increases and the fact that I do not get all the discounts mega-sellers get, since I have only a basic store, I will be forced out. And I'm not at all surprised that buyers don't know all the rules/regulations/policies in this place. There are so BLASTED many of them, who can keep up, especially when they change them every time they change underwear, or invent a new one to favor the buyer even more. I had a bad experience as a buyer, as well, so it works both ways. There are some SLEAZY sellers out there, and I seem to attract them when I buy. lol I bought an $81 ice cream maker, advertised as never used, in the box, excellent condition. When it arrived, it was in the STORE box, its original container -- no cardbox around it, nothing -- which appeared to have been trampled by a herd of wild elephants, and was obviusly old as the hills -- even the colors on the box were faded and it was SO dirty it was pathetic. But what's worse is I opened it to find the metal bowl dented, scratched, rusted, obviously used repeatedly, and the lid would not stay on to make the ice cream. I went to him first .... he lied like a rug and told me it had sat in his mother's garage for 10 years and nobody ever used it. He insisted it was brand new, would not accept a return or offer a refund. I told him I supposed it rusted in transit, and someone from the post office had opened it and scratched the interior with a carving knive. I filed a claim. eBay insisted that I go to the store where this item was supposedly sold 10 years ago and get pictures of a new one and compare them with mine, and also forward all the pictures to them -- I had already forwarded pictures of what I received, so they had no clue what they were doing. Since I am disabled, I could not get transportation to the store, and even if I had, I could not maneuver around the store to do any of that, which I explained to eBay. They were sorry. Too bad. I was out $81. What topped it off was this morning when I received a notice that one of my posts in a discussion about shipping had been removed. I was criticized by another member for COMMENTING on an already answered question, after HE had commented on it himself! I replied, "Are you the hall monitor or what? lol" That was, in eBay's opinion, of course, "profane, vulgar, hate speech, disruptive, or hostile comments, interpersonal disputes, or threats of violence in a post," according to their policy? There was NOTHING in my comment that came CLOSE to their policy. It just P.O.'d the guy, and he knew where to whine. His brother must work here, or something. That told me that eBay DOESN'T follow any of its policies, and all they're interested in is gouging you for more fees.

Hello better beware International shipping, altogether. We just lost a case with a buyer that as stated did not read the ad or was working a scam. I guess it doesn't matter which. Paypal gave him his money back. We did not get item back. Total loss as you eat the postage too, $84.00. I no longer ship Internationally. Too many people out there know Paypal and Ebay are offering anything for sale on Ebay for free, all you have to do get it, is if file a claim. In the U.S. you may also lose the item, but you probably won't be out the hefty International shipping fees.

I sold an item to a member back in February. In the paypal notes, they asked if I had any freebies I could send along since it was a gift for her sister. I sent along some tattoos. They claimed "not as described" that they only received the tattoos. Oh well, I thought perhaps the shipment was tampered with and gave a refund. Fast forward to May. I get the same buyer asking for any freebies to send along since it's a gift. So now, I probably think it really is a scam. I guess my lesson is to have her handle blocked. It's these 1 in 100 buyers that really make selling difficult. And we can't even give them bad ratings.

I can beg to differ i bought a n900 from a seller who described it as new when i got it i got in in a bubble back no battery no screen back price charger headphones. when i opened a case eBay ruled it in favor of the seller saying that the item matched his description i even have evidence of emails from the seller saying the pic in listing was the item, but found that exact same pic in another listing and on a website posted before his listing started. So the seller got away with a cool $270 just like that. So buyers do suffer also

I just had the EXACT SAME THING happen to me as the OP.... This is completely asinine but in my case I am absorbing more than just the shipping costs and eBay fees.... Check THIS out.... I listed a used nitro RC truck up for sale. Buyer was shipped the truck and upon receipt of the truck he inspected it, liked it, and gave me positive feedback for the transaction. A day later he contacts me stating that the truck is broken in a few spots (spots that would have been noticed straight away when unboxing) which he accused me of sending the truck to him in this state (not true, I even posted a for sale video of the truck on YouTube just for this auction overviewing the whole truck and PROVING there was nothing wrong with it). What happened is that the buyer purchased this item and then wrecked the truck (typical for these kinds of trucks that do 50+ mph). Anyhow, he felt entitled to a refund from me for HIS actions. I stated in my auction clearly "Due to the nature of the hobby there will be no refunds or returns on this item" for the EXACT reason of why I described above (I've heard of this happening before). I let him know that I would not issue him a refund. He then opened an "Item Not As Described" case with eBay. I rejected the opportunity to give a refund for the truck and escalated my cased to eBay customer support and gave a VERY solid case to them which should have been irrefutable by anyone. 3 days later I got notification that they sided with the buyer, WTF?????????????? So now not only am I floating the shipping costs and eBay fees I am also going to have to purchase repair parts for this truck, spend my time fixing, and hope to resell it for more than I did initially to even have any kind of chance at breaking even. This honestly feels illegal to me, eBay should have their balls chopped off for doing business like this. I SMELL A CLASS ACTION LAWSUIT BREWING. For the ridiculous fees that eBay charges people to sell stuff you would think they would support the seller, the ones who are keeping eBay's lights on. But no, they literally side with the buyer 100% of the time, this is an OUTRAGE eBay!!!!!!!!!!!!!! I will not continue to use your website to buy OR sell anything nor will I ever again recommend anyone to check eBay before buying something.

Hey All, We all seem to be in the same sinking boat with this Ebay Resolution Center. The only thing they do is let buyers cheat the Sellers out of hard earned money. I beleive that falls under the title of "Biting the Hand That Feeds You" doesn't it? I had a buyer open a case for item not as described because it was damaged in shipping. It was insured and he opened the case 1 month after he received it. My policy is to return within 3 days of receipt. Ebay favored him and I have to refund the money fully. I just don't beleive all of ebay is that way. Maybe its just 1 or 2 workers in Customer Service. It would be interesting to know who is finding in favor of the buyers would it not? Thanks

Yes, this is true. I have been on ebay 12 years with almost 2,700 transactions, mostly as a seller, with no negs. I have had a half dozen buyers return things to me claiming not as described - and when I received them back (these are used cameras, by the way) in 5 cases the item worked perfectly, and in one case the buyer destroyed my item and claimed it was my error. They do this so they can recover their shipping fees and not just the price of the item. I bend over backwards for my buyers, but I can no longer stay in business. Someone before mentioned raising prices, but I cannot do this and stay competitive. Everyone who comes to eBay is interested in one thing only - to get a bargain. So if I raise my prices, the item with sit unsold for months. Most people, I think, try to do the right thing. But there are enough that don't care about anything else but getting the best deal for them. And that is enough to make it not worth my time anymore.
