I asked a similar question about scalping in general - but it seems like these kid of questions go unanswered.

I thought it was illegal to scalp tickets.  I can't believe how much over face value people are charging.

Ticket reselling is regulated at a state wide level, not federal, so the laws are going to be different from state to state. This is most likely why the question goes unanswered because it depends on which state the seller lives in. As far as selling "free tickets" the eBay policy is that it is NOT allowed IF the event is free to the public. BUT if a radio station gave out free tickets for an event that the public would normally have to pay for (as an example) then selling them would be OK. This is stated on the policy page regarding free events.

"Members are not allowed to sell tickets to events where all tickets are free to the public."
