Well I´m from South America and the common of the shippings takes more tha 45 days to arrive , thats mean in that +45 days you hope that the item you payed arrive , but what happen if never arrive.. well first you have no right to open a case because has been more tha 45 days, and like the seller told me the 1st class they never show arrival!!!!! thats means I have no way to prove that the item never arrive!! My word agaist his word..ups he has my money and I have nothing...

In that case what should I do?? i send messages to him but he give no solution or intention to solve the problem and we are talking of a Top Rated seller ( supose to be the good ones??)

I do not intend to hurt your feelings with what I'm about to say nor is it intended to make you angry. Here goes...Buyers want their items shipped as cheaply as possible. Cheaply ALWAYS equals the slowest method available. That is the way of the postal systems around the world. If a buyer is unwilling to pay for Priority or Express with tracking or delivery confirmation they should not expect to receive packages quickly. You as a buyer should know this...especially knowing the slowness of receiving international shipments into your country. You admit that the mail service to you takes more than 45 days and yet YOU paid the seller to ship FCI...the absolute slowest method available for most international shipments. The seller will ship via the method you pay for and no other way.

 

Here's the problem Eleriador, you had the option of paying a bit more to guarantee the package arrived more quickly. You did not. You also had UP TO 45 DAYS to file a INR (item not received) through Paypal. You did not. Again, the seller shipped via the method YOU paid for and can prove that if they purchased shipping online. There will be either a transaction number in Paypal or any other third party online shipping service attached to your address but if YOU didn't request tracking, insurance or delivery confirmation the seller is not obligated to pay for it for you. The seller shipped as YOU instructed them to do. It is the fault of customs in your country or the postal service along the route...NOT the Top Rated Seller who by the way earned that status over the years by giving excellent customer service.

 

YOU had an obligation to protect your purchase by filing the INR through Paypal prior to the 45 day deadline. For whatever reason YOU chose not to use the buyer protections available to you. That is NOT the seller's fault.

 

Yes, they have an obligation to ship your purchase. Yes, they are responsible for it until it either #1- reaches you or #2- goes up to the 45 day buyer protection coverage you had with Paypal. You should have been more proactive by filing the

INR with Paypal. You did not.

 

There is however one other option that may be available to you. If you paid using a credit card you can contact the credit card company and dispute the charges letting them know you never received the package.

 

Blaming the seller at this point is bad manners on your part. I hope you are an honest enough person NOT to leave negative feedback since you did not do as you should have done in the matter.
