I won an item from a Canadian auction. The seller stated he would ship as conveniently as possible using Canadapost Expedited. The item, a laptop was received promptly, well packed internally however the large carton was crumpled in one corner. It looked as though it was dropped on that corner. A fellow on the Italian ebay forum posed this problem: He orders a tiffany chain from the Ebay USA, it doesn't arrive so he calls the Italian post office to track it, they tell him they have it in their warehouse and won't be cleared through customs or delivered to him because the box arrived opened and empty. This is what gets me, and it may have already been discussed before. Here, in America, merchandise transported between buyer and seller is usually regulated by Uniform Commercial Code (UCC). Typically, when the buyer chooses the form of shipment and pays for the shipping, they are assuming responsibility for the freight. This type of shipment is called a FOB Origin type transaction. Its simple. Its now up to the seller to purchase the insurance if they think the item is fragile and can't cover the loss themselves. The buyer doesn't need insurance. PayPal is the buyers insurance. I think this all has to do with the "I'm not responsible for loss or damage. Insurance is additional cost" terms added to description of auctions. After selling on Ebay for eleven years I just recently received my first negative. I have approximately 2,000 feedback, and my DSRs are three 4.9s and two 5.0s. As a winning bidder on a recent high priced item,the item I received is much different than what the seller sold me. I'm just finding out that even though I paid with paypal, and the seller admitted it's they're mistake that the item was listed wrong, the best I'm going to do on this purchase is get my money back and unless the seller agrees to pay return shipping, I will be out $300 to ship it back. I would like you to find out the answer to a problem regarding eBay's new insurance policy. They have not brought this up in their pages and pages of explanations about the changes. If we add our cost to insure an item to the Shipping & Handling Fee, and we have a reserve on that item, then the buyer can figure out what our reserve is.
