Mention the counterfeit status of the product in your dispute. Let Paypal decide and guide you on if you have to ship them back.

Thanks for your reply. I did mention they were counterfeit and the seller has already given me a full refund, so the case is closed, but he left me a note saying "SEND BACK THE DRIVES!!!!". I really don't want to because they're counterfeit and he'll sell them to someone else. I figure since I already got a refund I should be ok just smashing them with a hammer, but wanted to seek others advise first. Anyone have a 5lb sledge I can borrow? :-D

You should definitely send them back...Although I'm sure you know what you are talking about, it is not up to you to decide whether they are counterfeit or not...If I bought a pair of jeans and the arrived "fake" I would have to got through proper channels of having their authenticity verified...Could you imagine if ebay took the word of all buyers that items were fake??? They would refund the buyer and tell them to smash the item? If this were the case, buyers would really rule the ebay world......do you even realize how many scams this would create...

Your seller sent your refund, now send them their item! Your word alone isn't good enough...

I disagree. I don't think you should return them if you know for sure that they are counterfeit.

It is not up to the buyer to determine authenticity. How do you know they are telling the truth? (I am not referring to the OP, but to any buyer)..You must go through the proper channels of having an item authenticated. The word of the buyer does not cut it with ebay, as is with this case...Yes, the word of the buyer would stand up for a SNAD, but they would be required to return the item. If ebay let the word stand of the buyer alone, buyers would be claiming items are fake all the time, getting a refund, then keeping the item...

The seller held up their end of the bargain, therefore the buyer should hold up their end...

By no means do I condone the selling of counterfeit items. I truly loathe it.. But, I do believe in following policy and having items professionally authenticated with proper documentation..

Stealing? The seller is knowingly selling cheap knockoffs, fakes, counterfeits. What do you call that?

The only reason I got a refund is because he knows and I know that these are fakes. He put some up after I bid on this one with buy now prices for less than half of the real, genuine thing. If these were genuine and I was unhappy with it, I'd ask the seller if I could return them for a refund. Since their not genuine, I don't want him ripping off someone else and just assumed they're garbage.

Thanks for your post. That was my first thought.


BTW, I know these are counterfeit not only because they are some of the most low quality cheap discolored plastic pieces of carp, but they were also new in package without a UPC, Authentic code (SN), or License key as there would be if it was a genuine Kingston product.

You also have to wonder why the scammer, I mean seller would just issue an immediate refund instead of saying to send them back and then he'll refund me.

He refunded your money and you want to keep/smash the item...That is stealing..Until you can verify the authenticity by a professional it is not your decision to dispose of this...

As I stated earlier, I'm sure you are correct about it being fake, and yes it stinks to send it back to them. I'm sure that is EXACTLY why they refunded your money. I agree, I don't want to see sellers ripping off buyers either...But, you are not following protocol...If ebay allowed you, the buyer to make the "call", the issues regarding this on ebay would be the demise of ebay....

NOT saying you are doing this, but here is an example..

I buy a Coach bag on ebay...I receive it and decide to say it is fake although it is authentic...Ebay takes my word, refunds my money, and tells me to "destroy it"...Ya hoo! I just got my money back and I get to keep an authentic bag...

This scenario is why ebay has rules in place..You are not following the rules...Why should we take the word of the buyer that an item is fake....KWIM???

Await Paypal's instructions before sending anything back.

Since the seller has agreed to a refund, escalate the dispute to a claim and await Paypal's instructions.

All communication should be via the dispute console only.

Follow Paypal's instructions to the letter, if they say return,some form of tracing is required.

Seller already refunded, then you are NOT required and should not return counterfeit goods.

If the seller was so certain their item was NOT counterfeit, they would not have refunded without return of the item.;)

I see where you and some of the others are coming from. It just really leaves a sour taste in my mouth knowing that I bid on, won, and paid for fakes and that he wants me to mail them back so he can sell them to someone else as genuine. I guess I'll e-mail him telling him he can have them back if he sends me exact postage via pp. I refuse to be out one dime because of this junk.
