Re: Seller not replying back when buyer has issue with item

Nov 3, 2009 11:14 AM
Well if you've sent 3 messages over 6 days and have received no response - that's probably the time to open up a SNAD (signficantly not as described) dispute with Pay Pal.

Doing so will quite often get you the sellers attention, when emails don't work;)

Once you've done so - give the seller a few days to respond to the dispute - and if nothing - escalate the dispute to a claim.

Then just do what Pay Pal tells you to do.

Therefore, I do not believe it was an 8.

Was the other pair marked a size 8?

Someone pass me an explanation and a tanq on the rocks please.

You have two choice, assuming you used PayPal or a credit card to pay. You can decide to keep the one pair that fits and eat the cost of the other, or start a PayPal claim or a credit card chargeback for an item not as described. When instructed to return both pair to the seller at your expense with tracking and PayPal will refund your original payment.

If you used an insecure payment method, keep emailing the seller and learn a lesson.

I used paypal. I bought the shoes on two separate days so they were both paid for separately. I sent the seller a message saying she has 24 hours to contact me or I will have to take further action.

How do I open up a SNAD?

Wait a minute...you're telling us that the shoes were marked a size 8? When you say "marked", do you mean that they were tagged an 8, or was the size actually part of the shoe?

Did the auction contain any measurements? If not, did you ask for measurements beforehand?

If the shoe is actually marked an 8, and you did not ask for measurements, then I don't think you have any right to file a SNAD. Personally.

Are you talking about the Vintage Andrew Gellar shoes, or the Vintage Marylin Stilletos?

The auction for the stilletos had the measurements specifically listed, so that is not the seller's fault.

The Andrew Gellars did not list all the measurements, but, being vintage shoes, you should have asked. Vintage shoe sizes do not translate directly to modern shoe sizes. Also not the seller's fault.

I would have to disagree. If a zirconia ring was marked diamond a buyer would have every right to pursue getting his/her funds back. The seller possessed these shoes and, as the buyer relates, one pair was physically and visibly smaller than the other. Just because the seller wanted to play dumb (short of being blind) doesn't mean the buyer has to join in the game. Buyer should file a dispute followed with a claim. If the seller wanted to do the right thing he would have.

rla001 - see post 7

These were vintage shoes. Buyers should know the measurements of any shoes they buy online, because sizes differ among brands. But if they are vintage, then that information is even more critical.

I'm still waiting to hear from the OP which pair she is referring to, but if it was the pair for which the measurements were plainly listed in the auction, then it is definitely not the seller's fault.

Sorry, I should have been more clear. They are vintage shoes- both of the pairs. She said they were a size 8. I did ask her, since they are vintage, if they would fit a size 8 according to present day measurements. She said yes. One of the pairs fit, the other pair didn't- both of which she described as size 8. Since they are older, they do not say in the shoes what size they are.

I am talking about the Andrew Gellars. The others fit perfectly. I did ask because, like you said, they are vintage and the sizes may be a lot different.

Even with new shoes, sizes can vary dramatically from one brand to another, and even in different styles of the same brand. I typically wear an 8 1/2, but I have size 8s and 9s and even one 9 1/2 in my closet because of the way they vary. And that's with NEW shoes. With vintage items, all bets are off.

Buying shoes online is a supremely bad idea if you are not prepared to ask some very detailed questions and will be unhappy if they don't fit. Shoes are simply one of those things you must try on first before you know whether they'll fit, no matter what the tag inside says.

BTW, I used to sell shoes, so I know what I'm talking about. :-D

Wait a second . . . you asked for the measurements? Did the seller provide them? If so, and the shoes have different measurements than provided, you definitely have a good basis for a SNAD claim.

But if the measurements are the same as the seller stated or you bought them without getting an answer back, then you can't fault the seller.

I would agree with this but, may I point out, this seller is selling two pairs of shoes, both of which she has described as being a size 8. Being vintage, they do not have sizes marked on the shoes. Why would she describe the shoes as both being size 8 when one pair is obviously smaller then the other. This doesn't add up to me. And again, one pair fit great, the other was a good size smaller.
Also, it would be grand if she contacted me back to at least say what you have said so I could point this out to her.
