Seller not sending refund

In the beginning of September I bought an item that turned out to be defective, cheaply made and not even assembled fully. I had it assembled, but it still was no good so after much discussion with the seller he agreed to take the thing back If I would give him positive feedback. So I left the feedback and sent the item back. He received it and said he would refund me "right away". It has been 3 weeks and no refund. Each time I email to ask him to please refund my money he says "yes, right away!". Now it has been over 45 days since I paid and paypal wont let me file a complaint. What can I do? I feel like this seller is just toying with me.

I agree. Since your time has passed for filing an SNAD report with Paypal, there is nothing you can do, unless you paid via Credit Card. If you did, you can do a chargeback through your cc company. Otherwise, I do believe you are SOL.

Including the word “Feedback” or any reference to eBay Feedback in a listing title (except when that word is used to describe the item for sale)

Manipulating another member’s detailed seller ratings (DSRs) through a combination of repeat purchases and low DSRs to reduce another user’s Feedback scores, or showing a pattern of leaving positive Feedback with consistently low DSRs

Offering to pay members for their user ID

Offering to sell, buy, barter, or give away Feedback
Taking actions or using tools to figure out the detailed seller ratings that a buyer left for a specific transaction (DSRs are meant to be anonymous)

Working with other members or registering multiple accounts to artificially increase your Feedback score

Never allow a seller to string you along until the Paypal filing deadline has past.

Never allow a seller to make your refund contingent upon leaving feedback!

All you had to do was file with Paypal,return with the required delivery confirmation to the seller.

Paypal would have decided in your favor and issed a full refund.

Now your seller has your money, the item back and a positive feedback:_|

Why do buyers allow sellers to bully them like this, when Ebay/Paypal gives buyers the tools to quickly remedy this kind of situation?:_|

Did you fund your Paypal payment with a credit card? If yes , then file a chargeback with your card issuer now.

If not, then there is nothing you can do,except learn to follow Ebay/Paypal policies, when the item is not as described.

Thanks everyone..
Believe it or not, this is the first time anything like this has ever happened to me. I have been with ebay for 10 years. I knew that I had protection through ebay and paypal but didnt know of the time limit. Is there really nothing I can do? No way to warn other people that he is a crook? I used my checking account on paypal so I am out of luck there. This guy is a "Top Rated Seller". I did start the process with ebay but they just sent me an email that first I have to communicate with the seller. lol. Ive been communicating with him. If this seller is cheating me, he has probably done it to other people. His feedback is 100 percent.

Then the time should be protected, if you filed with Ebay.

It is unclear, if Ebay has started their claims processyet or everything is still being handled by Paypal.

What exactly did you file with Ebay? A non performing seller's report or a SNAD dispute?

Go back to what ever you filed and see if you can pursue it.

Otherwise, all you can do is add a comment to your previous feedback.

Example: Item turned out not as described,returned and seller refuses refund.Link

You might also try pulling the seller's contact info, give them a call regarding the refund.;) Link

I think the most important thing I've learned on the boards is to not let a seller drag things out this way. It's great to be kind and patient, but you can't let a problem go beyond 45 days.

I hope this works out for you.

I have called him several times and he always says " I will do that today" and then doesnt do it. I called him again just now....same thing. Says he is to busy to do it right now. It has been almost 60 days now and soon he wont be able to give me a refund on Paypal. I am just so upset. 269 dollars gone and there is nothing I can do through ebay or paypal.

When Ebay says to try and work it out with your seller, they do not mean to let it run past the filing deadline.

Did you return it with delivery confirmation to prove the seller received the item?

If yes, then file a USPS Mail Fraud complaint.

It will not get your refund, (unless many buyers have filed) but it will put the seller on notice with with the USPS Postal Inspectors.

Look here and send the link to the seller stating you will have no choice but to file with the USPS Postal Inspectors in view of the lack of prompt refund.;)

Look here and file with every agency you can.Link

Add a follow up comment to the feedback you left.Link

DO NOT mention Ebay/Paypal, the Postal Inspectors or any kind of "investigation". It would be removed by Ebay at the seller's request for Feedback abuse.:(

FYI Deadlines to remember: File a SNAD or INR with Paypal within 45 days from the date of payment.

Leave Feedback = 60 days from the date of auction end.

Credit card issuer= Check with your card issuer.

File a NPS (Non Performing Seller Report with Ebay= 60 days from end of auction.

No way to warn other people that he is a crook?

You may still have time to add a Reply to your feedback saying that you left positve FB in expectation of a refund, but no refund has been made after many enquiries.

Keep it calm and professional.

That does not tell other buyers what happened or how the seller operates.

Stating : Item defective returned seller stalling/refusing refund,Now has Item & Money

That tells the entire story!;)

OP, please contact the seller and let them know that since you have been very patient to no avail, you have no choice but to file a charge against them at their local police station.

See if you get your refund then.....
