Seller not sending refund

In the beginning of September I bought an item that turned out to be defective, cheaply made and not even assembled fully. I had it assembled, but it still was no good so after much discussion with the seller he agreed to take the thing back If I would give him positive feedback. So I left the feedback and sent the item back. He received it and said he would refund me "right away". It has been 3 weeks and no refund. Each time I email to ask him to please refund my money he says "yes, right away!". Now it has been over 45 days since I paid and paypal wont let me file a complaint. What can I do? I feel like this seller is just toying with me.

Thanks for your help, everyone! This morning I emailed the seller:

Since I have been very patient to no avail, I have no choice but to file a charge against you at your local police station. You have had your merchandise back for weeks and still have my money. I will go through any and all avenues available to me to get my money back, and to see that you do not steal from anyone else.

He refunded within the hour...........

Funny how he found the time all of a sudden! Good for you! Most sellers would never do this.

Why does everyone always give the answer..."threats"

my god people grow up and take responsibility for your actions!

there is always a chance of getting scammed, cheated etc especially when dealing online.....is it right? NO...does it happen,,,yes often

OP if you had to take the item for assembly...that means your not capable? Are you sure you actually didn't assume something when reviewing the auction prior to bidding?

Buyer didn't purchase an item that needs to be assembled. If I buy something that's already put together I expect it to be that way (unless the Seller put that info in the listing).

Seller wanting pos feedback in exchange for a refund isn't wrong, but how the Seller wanted it was (Pos Feedback in exchange for a return after the refund is given is SOP IMO- Buyer should never feel forced to give a Pos in order to get their $ back). The Seller lied to the Buyer numerous times (saying will refund right away but not doing so).

Seller deserves a neg and to be dinged over this behavior

So you think that someone who is scammed should just accept being scammed and drop it? The seller AGREED to the refund, the item was returned, and the seller then decided to keep the item AND the money.

And you think that this was ok and that "threatening" him was wrong? Why? Because he's a seller? He STOLE from her.

And you're telling the posters here to grow up?
