Don't know how long EBAY will allow this post before coming up with some policy infraction and taking it down and closing my account, but I have a family member that is a class action lawyer that was successful in suing Alltel for hidden fees. If after review his firm feels a class action suit is warranted would you be willing to explore the option of joining a class action suit againist EBAY and or PayPal for holding your funds from successful auctions or fixed items because of a change downward in seller performance or other policy changes?

Not happy with money being held. Since Dec. 2011 I have been a Top rated seller selling over  $7000.00 of merchandise,and now I find out that my DRS has drop below standard. Because A buyer purchased and item from me, gave me positive feedback, while also dinging my stars. Now e-bay has several hundred dollars of mine being held because DRS below standard. I have had nothing but positive feedback from day one,  I am so pissed off because I talked to a e-bay representative, and All they could do was talk in circles. And after reading this forum, I have come to understand more clearly that this is nothing but a scam on e-bays part. I'm  ending all my listings and closing my account e-bay and paypal the evil sister comp .And will be looking for Class action suite against e-bay and paypal.The ceo for e-bay is the ceo for evil paypal. And strongly advise everyone to do the same. I just hope we are all not to late.

I just won a Class Action against Chase Bank and am down for another fight.

 

I have been a member since 97, 830+ positive and no negatives.  I have been told my funds are on hold b/c I don't meet the standards.

 

Wait... a 97% is BELOW standard on shipping charges?  Someone has a bad day and takes it out on me, so I get dinged, allowing Paypal to hold OUR funds and make money on the interest?!

 

Heck, I even accidentally clicked on a 1* for a seller when submitting feedback and now I feel horrible.  We do an amazing job and they are now just looking for ways to make more money.

 

I'm sending this over to the law firm that represented me (us) against Chase to see what they have to say.

 

Count me in and please let me know what else I need to do.

You can sell on Etsy. They are like E-bay but for handmade items. You can not sell any items that were purchased though as you can only sell handmade items. Artfire is good and Craftisart. I had over 125 transactions in a year and I got 3 negatives in a 2 or 3 month period and E-bay restricted my account. I can no longer sell but I am more then welcome to buy....lol. I make renaissance costumes and one person sent me an e-mail on a Sunday and gave me a negative on a Monday, before I even woke up! That is not the first time that had happened either. This was the first e-mail she had ever sent to me.  Ebay actually did me a favor though because the customers on Etsy are so much better then E-bay. Now I use E-bay to find things and then I go out of E-bay and purchase them on the internet.....lol.

I just read Hondamedic's link: Hardly a win for the rest of us. According to that article, here's what Ebay/PayPal have come up with now:


"While terms of the settlement are as yet undisclosed, the litigation has not stopped PayPal from expanding its holds policy. PayPal sent an email last week sharing its plans to update its "Funds Availability program" to add additional circumstances in which it could hold seller funds, including "Sellers who sell an item that has a sales price that is significantly higher than the average sales price of items previously sold by that seller."

 

I wrote to my states' banking regulator regarding the holding of funds by PayPal and their answer, in essence, was, "As long as you use Ebay/PayPal, you have to play by their rules". In other words, they aren't governed by anybody.

Many of the replies on different post in the various chat rooms are by EBAY employees that have accounts to sell on EBAY, thus making them appear to be buyers or sellers like the rest of us.  It does not take much attention to various post to see who answers most post with links and “inside” information. Just keep an open mind when reading all replies as you may or may not be talking to an EBAY employee.

Ebay has made it nearly impossible to be a top rated seller for one reason and that is greed.They will keep coming up with more and more gestapo rules to avoid giving sellers the 20 percent discount.I would be the first in line to sign a class action law suit against these good for nothing ignorant losers.Ebay is one of the most poorly run companies I have ever dealt with.If I didn't know any better I would think the company is run by the North Korean Goverment.They go against everything America stands for.I also know thousands of Ebayers that have been screwed by Ebay that will also sign a class action law suite.Just let us know and we'll be there.

I myself am totally angry with the treatment of ebay user being screwed with this 21 day hold of our money. I've been with ebay since 2003. I sold stuff in Aug. w/o any problems. After there new criteria which i was told was started over a year ago. As ebay users we all pay the same fees yet there's a bias separation right in front of our faces. Why? Because we haven't sold enough items with there new criteria. What about a grandfather clause?, What about our positive feedback? Seems pointless to even have it. I'm told yesterday that it's a safety reason for the buyer. What? What about the seller,What about our selling history? Let alone Buying history? After i receive my money in 21 days. I'm closing my account and support local stores by doing consignment. Ebay you suck!

Ebay is BEGGING for a competitor.  Serve.com rips Paypal to pieces, with no transfer fees and they only charge when doing actions that I normally never do.

 

Reach out to AmEx and Serve, stating your desire for an AmEx/Serve backed auction site.  They would be an immediate competitor and would pull a ton of traffic from FeeBay.

 

When you stop taking care of what matters most, your customers, you begin to fail as a company.  eBay is failing and now VERY far below a Company Performance Standard.

 

Good lord, imagine if they needed to meet the same requirements they put on us.

People, myself included, would take you a bit more seriously if you at the least demonstrated an understanding of the word "SUIT" vs. "SUITE."  I can't take you seriously with a header like that.

i sure do think this is not right at all! you sell something, provide shipping tracking that item is shipped but only comes out of your bank account not you paypal account. this is my only means of making money to make ends meet and now to know it will take 2 or more weeks before i can get my money after it was paid for, shipped, and they are enjoying my item and i can't pay my bills because Ebay wants to hold my money! so very sad that Ebay has come to this. the hurt that they are causing us sellers. besides, where would Ebay be without us sellers? it is totally our money not Ebay"s. when you go to a store and purchase something, they get their money before you get your item. yes...this is so wrong what Ebay is doing! behind you all the way!!

not sure if anything has or ever will be started but i'm in. i do enjoy how e-bay is quick to charge their fees. but it takes them 21 days for me to get paid. like everyone else i have been with ebay for a very long time probably 8+ years and i don't sell much, but i shouldn't be punished for that. i guess my biggest gripe is we should earn interest on the money they hold or we shouldn't be charged a fee until several days after our money is released.

Is your family member going to start the class action suit and if so when?

Or is this just a bunch of talk just like the people who want to boycott e bay and paypal by not listing or selling and pulling out their funds from paypal but do nothing.

A lot of seller's and buyer's would proably join if they knew more information and when things will take place.

No this is no hype or some frustrated seller just blowing off steam. The reason for the wait was to see what kind of interest or feedback there is. Also they are studying laws and precedence. I am not a lawyer so I don't really know all the procedure. This is no way a guarantee that they will proceed in any manner. They are however in the class action business and it is being reviewed. As soon as I know if anything will or will not take place I will post it if EBAY does not shut me down from posting.

I'm furious and definately in! Been selling over 10 years and have recently sold quite a bit....well over 100 items in the past year. Feedback is 100% with no issues, yet a few people gave me low stars because they felt I overcharged for shipping? How can you hold my money because of a few people's "OPINIONS"??? I can easily say that ebay overcharges on fees, especially having the balls to now charge a final value fee based on the shipping cost! And what does one have to do with the other??? I have 100% feedback, but a couple people didn't like the shipping charge so now my funds are held for up to 21 days??? WTF??? Makes zero sense and I depend on those funds to cover the shipping costs with my paypal debit card. Now I'm supposed to go out of my own pocket to pay all the shipping charges and keep track of and wait for them to release the funds?? Get outta here!!!

 

This just makes no sense at all...I'm done with ebay unless a LOT changes! Count me in if anything happens!

What is so stupid is that buyers can leave stars on shipping unless we offer it free. If a buyer doesn't like the shipping cost then they shouldn't buy the item. DUH! It's not as if the ship cost is a surprise until they go to pay.

Ebay's answer? Offer free ship and it's an auto 5 star rating. Big deal.

Boycott eBay is the answer. Ebay wants more buyers about time to let ebay go out there and buy their own merchandise. I DO NOT WANT EBAY AS A PARTNER. ALL I NEED IS THEIR SERVICES. GO TO ETSY ... I AM SELLING THERE !

Hello ebay Members,

 

Ebay has once again fallen on their own Sword, they are always fixing things that aren't broke.

 

The economy is in the dump headed to even worse times. I'm quite sure ebay (management) is not aware of it. Ebay is shrinking everyday and management, who is unaware of the true facts about the slump in the economy, thinks this new "holding funds policy' will attract more buyers. Well, you can have all the buyers in the world, which they have, but they forgot that sellers need to be there also.

 

Yes, they have a hold on my paypal account. All my listings have the shipping costs stated in the description, yet the cowardly buyers leave a postive feedback and a bad strike in shipping costs.

 

I called ebay upset not knowing this could be done (June 22). Ebay says I should offer free shipping and add onto the price the shipping costs to avoid the bad strike.

 

Well, here's the flaw: Shipping items larger than what a Flat Rate box will hold varies quite a bit if you ship from say Mule Creek to El Paso verses Mule Creek to New York. So, by doing the free shipping thing that ebay suggested, I would be ripping off the local closeby buyers. (The added on shipping costs to the fixed price would be estimated according to what it costs to ship to NY, not to Silver City which is in the same county as Mule Creek.)

 

Well, all I can say is ebay (management) must be in another world, high on drugs, laughing at us peons.

 

Ebay tells me on the phone that they want to partner up with me. I told ebay I don't care to have you as a partner only as a service. I think ebay is trying to get into everybodies pocket a bit deeper.

 

There is nothing I can do about this matter except end most of my listings and sell elsewhere.

No money needed. As I have stated in the past, this is a real gathering of facts and is not a scam or some disgruntled seller boasting about what he or she may or may not do. If anybody asks you for money you might want to think otherwise about it. I would not send money to anybody until I found out more.

 

They are reviewing the information and have not yet accepted the case, however they are very interested.  If and when they do, it is my understanding that they will not take money on an individual basis. However if it reaches the point that they are going to pursue the case, it will be made public knowledge on how to proceed.

 

But to answer your specific question, please do not send me or anyone supposedly connected with this action, any money unless you deal with a reputable law firm that you have personally checked out.

I buy alot in ebay .... so now just to get these complacent sellers to wake up I am going to give 1 star to every seller that I buy from.

The sellers will never know who down graded them. Things need to change for the better for sellers. Time to do something NOW !
