Don't know how long EBAY will allow this post before coming up with some policy infraction and taking it down and closing my account, but I have a family member that is a class action lawyer that was successful in suing Alltel for hidden fees. If after review his firm feels a class action suit is warranted would you be willing to explore the option of joining a class action suit againist EBAY and or PayPal for holding your funds from successful auctions or fixed items because of a change downward in seller performance or other policy changes?

I knew I could not be the only one. I am going through the same with them now.. Been running on 4 months with them fooling around on holding funds. One thing after another.. Seem to make up the rules as they go along.

the interest on our money is a great revenue stream for them and how do we know that we really have a bad response from a customer It may just be that ebay is looking for more profit

i am getting tired of reading all of you peoples gripes about how terrible ebay is. get the balls to do something about it.stop selling!!!, i did., i had over 1000 positive feed backs, stopped selling appox 6 years a go while ebay was still a decent site. started selling a month ago, it only took me 5 items to realize what had become of this site. somehow a bunch of absolute idiots have taken control!!!!. again if you do not have the guts to quit selling, shut up.

Been selling on eBay since 2000.
Have loved selling on eBay until now.
Never had any serious issues with buyers.
I received 2 negative feedbacks in 1 month. One from a customer who complained it took too long to get his order, which ended up being his fault since he never answered his phone or the numerous messages left by the freight company trying to schedule an appointment. Second negative feedback was from someone unhappy that I ran out of stock.
Apparently this makes me a risk and they decided to hold my funds.
I sucked it up and decided to wait for my next evaluation which occurs on the 20th of each month. At the next evaluation my scores should have put me to Above Average Performance, yet they didn't change my status. I called them and they informed me that due to the type of "penalty" imposed that the penalty had to remain in effect for at least 30 days after they implement it.
See, what they did was they evaluated my account on the 20th of May, then they waited about a week before they changed my status to Below Average Performance. So on June 20th the "penalty" they imposed hadn't been in effect for a full 30 days. I now have to wait until July 20th for my next evaluation. This was pretty infuriating.
I've been an extremely loyal and good seller on eBay for years. I've always tried my best to be a good seller and have done a really good job at that. To have eBay now treat me like this is just insulting.
On top of all this, eBay has made it extremely difficult to contact anybody of importance. You can call eBay and talk to a peon whose basic job is saying, "I'll pass along your comments." You can't respond to any emails left by eBay. You can't email eBay(if you have any email address to contact them please let me know).
At this point I would leave eBay in a heartbeat if there was a viable alternative. Unfortunately there doesn't seem to be, at least not for me.
I would be 100% behind a lawsuit just to get them to remove this ridiculous policy of holding funds.

I agree, however, until then we can take Immediate action as follows and I have posted this several times.......
I have been selling here 11 + years. Anyone that has been using Ebay for awhile knows that every year they think of a new way to screw the seller (and we are ebays customers, not the buyer) The seller generates the money for Ebay and Paypal, it is a free service to the buyer, while the seller pays all the fees, yet have none of the rights. Don't get me started on what they have turned the feedback system into. This time I feel they went too far, by holding my money for 21 days. Therefor, I held the items sold for 21 days until payment cleared. My situation was unjust, just like so many others that I have read here. If you click on See all shipping details on any listing, it clearly states that item will ship in__ business day of receiving cleared payment-.. I would suggest that everybody abide by this rule. I emailed each buyer and told them I would ship in 21 days, because Ebay held their payment, my funds, and suggested that they call Ebay. If I sell something, I would not allow the buyer to remove it from my house unless I had cash in hand, the same applies here, and this company is way out of line to even suggest it. Sellers here need to stop being sheep and make a stand. If everyone that has been effected by this rule stand together and ship only after their payment clears, Ebay and Paypal is going to be very busy with quite a few unhappy sellers and buyers. They may not care about us sellers, but I do believe they care about the buyers. This is the only way I see to change this policy, and we all know it has to be changed. I am currently seeking to participate in a class action regarding this also. I have also been a member sice 2005 as Famcostores. I I am a 20 with 100% positive feedback and they are holding my latest sale for 21 days via pay pal. They claim I need to establish a sales record with them and they will remove the 21 day hold. Establish a sales record ? I have been selling with no complaints since 2005. Now they say they are also holding funds if you have not sold x number of items in the last 90 days. My buyer has the phone I sold, I have all the paper work from the post office and eBay will not acknowledge my physical receipts , phone call from buyer or email the buyer "it's against eBay policy for them to email the buyer". Maybe 249.00 isn't that much to everyone and maybe 21 days doesnt sound that bad to everyone ... but do you understand that eBay and Paypal get to PROFIT for the listing, for the commission, for the paypal processing and get to profit thru MILLIONS held until the decide to give the money back. No escrow fund as Florida clearly requires with interest paid to the seller. Just so you know, they also have asked for payment .. so they want me to PAY THEIR FEES BEFORE I CAN EVEN GET THE FUNDS! If an Attorney has already started a class action for this, please let me know so I can reach out to them.

Wanted to provide an update. The buyer has confirmed receipt via 100% positive feedback so I am a 21 now and 100% positive. Regardless, funds will not be released for 21 days because eBay will not accept this as confirmation because the cannot be sure it is really the buyer providing the feedback. No electronic tracking.. you can forget it .. you will never see your funds before 21 days. The policy around this clearly shows that eBay is forcing us to choose more expensive shipping while offering reduced or free shipping to the buyer. My biggest complaint is still the same. This policy is a strong arm tactic to force the seller to use specific shipping methods and allows eBay to hold millions? of dollars daily thus profiting more from each and every sale. eBay - hold my funds for 21 days .. fine .. put it in escrow and pay me the gained interest !

The problem is it's a statue that I have to ship via freight, and I don't have the $300 to ship the item.

Not until you ship, until they can verify via electronic submission to USPS, Fedx , UPS etc .. I have 2 commercial tanning beds that I was going to list @ 3400.00 each... Of course, this is freight as well so there will be no tracking method GOD can use to confirm delivery. So they have already been listed elsewhere. Believe me, I wouldn't let my mom keep 3500.00 for no other reason that to deprive me of it. This class action will come .. but we will still be the losers .. Ebay and Paypal will pay the government fines and the attorneys will get the balance of the settlement while they send us a few cents.. so fight back the only way you can, don't support companies that abuse you. We are the customer right ..they are what they are because of us .. right?

PLEASE....How come nobody is getting together on this???....It has to be stopped !!....I put my blood, sweat and tears into my ebay business...It is all I have !!!...IT is my only income....Doesn't ebay know that most of their sellers count on them????....Don't they know that WE ARE THEIR CUSTOMERS ????....I guarantee you they will have a very hard time replacing all the established sellers they lost thru this....We are what made ebay what they are !!!....New sellers are just starting out and most will not stay long if this is the way they will be treated...At least some of the established sellers choose to stay because this has been their livelyhood for so long...but we have to save ourselves...LETS DO SOMETHING ABOUT IT !!!!
THIS IS THE WAY IT WORKS....
Ebay is Paypal...Paypal is Ebay...Ebay is the Parent and Paypal is the child...They set up 2 entities so that Paypal can do their dirty work for them...Funds that are held are based on ebay's parameters and rules set for paypal to take action...
I am an esablished seller on ebay for over 10 years....I have 100% feedback rating and anywhere from 4.74 to 4.97 STAR ratings (almost 5 star) in the five categories that ebay buyers can leave ratings for me....None the less...ebay feels I am a below standard seller and therefore justifies holding my funds for 3 days after delivery is confirmed...that can be over 2 weeks if item is shipped overseas...Meanwhile ebay sees fit to coninuely charge me all fees while I live pennyless for several weeks at a time...unable to pay bills or buy items to sell...How in the world do they think they are improving a sellers performance by this dictatorship method?...I am and continue to be a professional and dedicated seller doing the same business as always...I absolutely cannot control less than a handful of buyers out of 200 that maybe felt they didn't receive their item as speedy as they wanted or thought my shipping charge was too much (which is not true)....These below standard ratings came from people buying dirt cheap items from me and complained about the economy shipping cost of maybe $5-6...Could you believe this????....This all proves that ebay either doesn't know what the hell they are doing...and that money is definitely the reason....

I'm on board too. This is smiliar to extortion by a landlord who is highjacking your mail and turning off your utilites for no reason.. I can't see how it is legal. I just listed item for the first time in 2 years and did not realize this policy until after the sale. I do not recall seeing anything to alert me of this before I completed the listing. It was probably there somewhere in the fine print, but very misleading. Now I am left holding the bag for 21 days... a form of extortion.

I am very upset with ebay. I got one crazy negative feedback from person that was un willing to corrporate and they hold my funds and blame me. After 300 positive feedback they give credit to a buyer with very bad feedback and messaging profanity like no one is this world ever did to me. So Sad with the way they treat buyers!

We are an NPO (Not for profit organization) We have recently started to trial use eBay and PayPal and will not be staying long unless both eBay and PayPal make some fundamental customer service changes and operate a solid policy that has coherence and transparency.
PayPal in particular has behaved in such a way that the only course of action should be thorough investigation, to include collection of verifiable data that demonstrates banking malpractice, any material that demonstrates abuse of position and then the courts.
The best solution is an alternative. We are currently investigating the possibility of creating an alternative and will post on our main website more details in due course. (omfinity.org)
In the meantime, very briefly, yes, we would certainly fully support action that cleans up the act of both companies..

How fast can we get this started? Ebay just put me in your "Special Program" because of a low communication score and is withholding my money. The poor communication came from my being out of town longer than expected then got severely sick upon my return. I told them this but they don't care, just read to me what is in their response booklets. Even with proof of tracking, the buyer received the item and left glowing feedback, they say I still have to wait 3 days after buyer gets item to have money released. This is my only means of income and I had to use my birthday money to mail items because they are withholding the postage money as well. They say if I show perfect score rating and basically behave myself, I can come off the "Special Program" on the 20th of August. They said every sale will be this way until the 20th. If my new review is not up their new standards then I will continue to be punished. I don't like them holding my money and using it for interest to generate more money for themselves. When can you get rolling with this suit?

Other internet sales sites are a joke so don't waste your time.

Remember when AOL was number one??? IBM?? Motorola??? Like every number one company a competitor with better rates, better service and pricing comes along . How many of us use aol for internet, own a ibm computer or have a motorola phone. I believe Ebay's and Paypal's won't be so dominate in the future, competition is always around the corner and I believe the only one to challenge Ebay and Paypal is Google. Who knows google may open it's store without clicks.... Just a thought..
At the start of my ebay store, my funds were held for Ebay claimed I was growing too fast and needed to ensure that I would be around so they held my funds for 21 days just as my business exploded and the only way I could get the funds released was with customer feedback and I need to upload the tracking number onto Paypal's website (hmmm doesn't paypal get the tracking numbers from Ebay). It was 21 very hard days...But I played the game and got the funds released in 3 days... by providing tracking, proving delivery and gettng customer feedback.
Ebay's new policy is aimed to save them the 20% that they were paying to the seller each month. This is just a cost savings approach and they have made it so hard for the sellers due to unrealistic expectations from Ebay and some devious buyers who know to how manipulate the not as described rule that more sellers are choosing to not take returns and not hurry to ship items out. So Ebay is saving millions at the expense of the seller, it is really worth to bite the hand that feeds you.
Very sad for I understand from my friends who sold on Ebay for years that the Meg W. era was the best..... .

Well, I wouldn't give much credit to Ms Meg, she bailed out when the going got tough and she certainly was implimenting many rules that didn't need to be.
She tried to convince California voters that she created ebay, outspent brown nose brown by millions yet lost the race for governorship, she tried to buy it and couldn't. Yeah, she would have been a better governor than that little socialist brown, but it just shows you, you can't buy everything. She probably would have won if she had just said she helped ebay become great, but as ego goes...
The great era for ebay was before they purchased paypal, and I give very little credit to Ms Meg. The credit belongs to the many sellers that sold on ebay.
