FAIR? Int'l Item Confirmed delivered BUT eBay refunds Buyers payment
Aug 11, 2012 08:58 AM

DETAILS

7/26 Buyer opens Item not Delivered case

7/26 Seller responds w Int'l Priority Customs/Tracking Form #

7/29 Seller escalates case to eBay Support since no response

8/10 Item is (delivered) picked up at Post Office by Buyer

8/10 Customer Support REFUNDS $550 payment to buyer

Though item is clearly picked up at Post Office in Bangkok. Resolution Team tells me since I escalated the case AND did not utilize sigature confirmation I CANNOT PREVAIL in this case. No if's and's or but's. Just a TOO BAD.

Now, I am out $500 of product. This is obviously a rule  that can EASILY be taken advatage of by SCAMMERS. And eBay just wants to turn their head and say OH WELL.

Wow! Is it really that bad?

Even with written proof that the item was delivered you can't get your money back as a Seller?

That is not cool at all.

Ten years ago eBay used to be an endless field of flowers and greenery under clear blue skies. Full of innocence and opportunity for all who partook. Now when I think of eBay I see a grey damp dirty soot stained factory infested with paled skinned underpaid, starved worker-slaves toiling out a meager living under a black smog infested industrial sky where 'big brother' helicopters fly above gunning down anyone who speaks up or gets out of line

SO sorry for your loss/predicament.

An "Item Not Received" [INR} claim is about the ONLY thing ebay/PayPal does offer "seller protection" against...but the seller MUST follow all the ebay/PP rules for the protection to be provided.

On transactions where the payment received is $250 or more, sellers MUST be able to provide online Signature Confirmation proof of delivery to win an INR case filed.

On transactions where the payment received is less than $250, sellers MUST be able to provide online proof of delivery to win an INR case filed.

For international shipping, packages MUST be shipped utilizing a level of shipping service that provides online proof of delivery...ebay/PayPal will NOT accept just a "customs shipping number/receipt" as proof of delivery.

Yes, but when a USPS website shows,

"Status of Your Item: Delivered"

there should be leeway. Or more time to prove it was or was not received by the buyer. In this case the buyer had to physically pick up at the post office, probably show an ID and pay a tariff. But I guess that doesn't mean anything. Let them keep the product for free. THANKS eBAY!!!!

Very unfortunately, you're right...it doesn't when ebay/PP are in control of your money. Their requirement for "seller protection" for payments (item price + s/h) over $250 is online Signature Confirmation proof...period.

Again, so sorry you erroneously believed you had yourself safely "covered" with the proof you provided. If (?) you decide to continue selling from this site and accepting payments through that money transfer service, you may want to memorize their "Thou shalt ..." MUSTs.

Yes, but is it FAIR for it to be so cut and dry? That is my question. Fairness is what eBay should be striving for. Make a ruling that is fair! Once they confirmed it was delivered but not with signature confirmation they immediately ruled in the buyers favor and gave him his money. Does that even seem logical?

It is obvious that somebody now has MY $500 + $52 worth of product. Most likely the buyer. "Period" is just too one sided and makes it easy for some to take advantage of others.

I will now have to regretably cancell my son's going away party. $550 to eBay/PP is not even mist in a bucket of water. So, THEY DO NOT CARE. I hope the recepient of my goods enjoys his reward for learning how to take advantage of eBays/PP stupid rule!

It wouldn't have happened if you played by Ebay's rule and added signature confirmation.

Yes, but is it FAIR for it to be so cut and dry? That is my question. Fairness is what eBay should be striving for.

The entity "ebay" doesn't care about fairness...hasn't since at least 2008 when the major "New Rules" of spring '08 changed the site from being "only a venue" to "J.D.'s dictatorship"...and why we haven't sold or bought anything through ebay since then.

Once they confirmed it was delivered but not with signature confirmation they immediately ruled in the buyers favor and gave him his money. Does that even seem logical?

Unfortunately, ebay/PP "rules" don't have to be logical...just enforceable.

So, THEY DO NOT CARE.

They only "care" about rules and high dollar revenue producers...and even then, they choose WHICH rules they wish to "care" about as they sometimes "turn a blind eye" when a rule is blatantly violated by one/some of their "chosen few" favorites who bring high revenue into ebay's pocket.

As Jelly explained to the Dr. [Billy Crystal] in "Analyze This"...."It is what it is."

Since the buyer didn't respond to case and you escalated, perhaps you may want to contact the buyer and ask them kindly to respond to you. Worth a shot.

I am so sorry.

In a naive tone, I e-mailed and messaged through eBay the day "they" slapped me in the face, "It shows item have been delivered, did you receive them?"

Nothing.

I'm confused.  How do we know for certain that it was the buyer who picked up the item and not someone else?

The item was actually picked up from the Bangkok Post Office and according to the state run postal system, Thailand Post Co., Ltd, "only the addressee has the ability to retrieve a package held at the facility". PLUS, since a customs duty had to be paid to the post office, addressee is required to provide proof of identification with a official state ID. If the intent of the ruling is to confirm the item was received then there is no better evidence then the requirement of the country that requires the addressee to provide ID AND sign for the package. I'd file a complaint with the Internet Crime Complaint Center run by the FBI. At least you can give them the info; they can enter it in the database, and the person along with address info is in "the system" and starting to be tracked.
