So I listed an item on here. It sold I uploaded tracking and buyer received it. When she got it she emailed me and said they smelled like smoke and it was bad business and she wants her money back and wants to return it. I dont do returns. In my listing I stated please ask any and all questions prior to bidding as I do not do returns. I had 100% feedback untill now. AND now I have a resolution case against me for her money back. I went ahead and provided the tracking number in the case and how I described the item. I went ahead and escalated the case because we are obviously not going to reach a resloution. This buyer has left many neutral/negative feedbacks for other people. My question is how do you think they will decide on this case? Has anybody had a similar situation before? Thanks in advance guys!

You're not going to like this...

 

You're going  to lose, eBay is going to refund their money, you're going to get neg.d.

 

You can have a "no returns" policy here, and if you won't accept a return, eBay is just fine with that.  But eBay has a "refund" policy (Buyer Protection), and they're going to refund the payment to the buyer, whether your item ever gets returned or not.  You should probably ditch the "No Returns" policy... all it does is scare good buyers you actually want, and it's like waving red meat in front of problem buyers - they already know it's totally unenforceable. 

 

I can't tell which listing it was, but I looked at one of them, and it said "no smoking home"... exactly what was the buyer supposed to ask if that was in the listing? 

 

If they've been giving out lots of bad feedback, they're either really picky, or they're scamming people with Buyer Protection (or threats to open disputes).

The item that was sold was my mothers which did belong to a smoking home. My items come from a smoke free home which is why I listed that. You are looking at the wrong item. The case did escalate and it seems like they kind of sided with both of us. She got her money back and got the item and I got to keep the money as well. I wasn't held responsible. I think in general I am just going to stop selling on Ebay because unfourtunatly there are to many that ruin it for the rest of us. I don't do returns because it is such a hassle for everyone. I am not even sure why a buyer would want to pay for return shipping. They still end up losing money? This is the first time this has ever happened to me and it makes me  sick! I couldn't imagine people doing this to other people to make money and keep an item. Either way I blocked the buyer and even though I had to leave posititive feedback I wrote in all caps what a horrible buyer she was and would never let her buy from me again.  Lesson Learned: Ebay is full of scammers! Period the end!

The end may not have been reached yet.

Sellers are not allowed to leave a green dot (+) with ANY negative wording about the buyer. If the buyer reports the FB you left on her profile, you may receive a selling violation "mark" against your account.

I do believe that scammers take advantage of the way ebay favors them and they do things like this. I have offered to return full refund if buyers return the items and no. They still get mad because they want to keep the items and want money back too. I am sick of the way this selling is turning out that I have remove my listings. I onced asked an ebay rep on the phone if sellers had any say so in a matter against a buyer and he told me "No!"

Lurker- Like I said I am pretty much done with selling on Ebay. It seems to me that no matter what the buyer says/provides its a losing battle either way. So at this point I don't care what she says or does or reports. I don't plan on selling anymore. It's gotten a bit ridiculous and I know alot of other people feel this way as well. I just keep thinking to myself "karma" as she is a seller as well.What goes around comes around!

Waytohigh- your absoloutely correct! there are so many buyers whom take advantage of sellers.  I am 100% honest about everything I sell. Had I known that smoke was an issue for this person I would have let them known it was a smoking home. I just can't imagine how people could scam other people that way. It's ridiculous. Good luck in your future endeavors with Ebay :) Hopefully it improves for you!

Thanks..but after reading everyones expierances they are just like mine. I am so fustrated and upset that I have remove my listing and that is it. Good luck to all honest and hard working sellers because the way policies are going this is not gonna end good.

Lurker- Like I said I am pretty much done with selling on Ebay.

We ceased all of our ebay selling (2000+ sales) and buying (400+ buys) activity when the spring '08 "new rules" took effect and ebay became more like a dictatorship instead of "just a venue" for both buying & selling activity.

Foxy: You should just have apologized, agreed to a return & refunded the buyer's money. End of story. Now you have a negative, ebay will side with the buyer & your putting a negative comment in a positive feedback will be removed. You handled this the wrong way.

I'm no expert..I've only been selling on eBay for a year. But, lately the heat has been turned up because of eBay rules that apply in the Buyers' favor. 

 

Now...If they do give you a Bad Feedback, then you can write something Nasty under the Feedback they left.  Something like..."The Buyer is a Thief and want their item and their money too!"

 

Even if it's not true!!

I personally think you handled it just the right way!  I mean you said to ask any and all questions....so if a buyer doesnt want to buy something from a smoking home then shouldn't she verify with you that you don't smoke????

 

I too think it was buyers remorse and she was just using that as a lame excuse so you would give her the money back.

 

1 negative feedback with all of your other positive feedback will show buyers that obviously this was a buyer who is a "problem buyer" anyways. Shes basically making herself look bad. Good luck to you. Don't let buyers like her ruin it for you!
