I bought one of those Digital Touch Screen Media Players from an eBayer and insured it for $2.50. The Track and Confirm showed that the package had been delivered to me, but I never got it. I went to the Post Office to follow-up, and found out that there was no insurance on the item. The eBayer seller did not buy the insurance; the person simply pocketed the money. Now, I have no recourse, as no one in my apartment building has seen my package or knows anything about it. I have told eBay about what she has done and I have an "escalated claim" with PayPal about it, but I still feel empty and violated. Does anyone else know how I feel? The eBayer was unsympathetic to my plight, saying nothing about why she did not buy the insurance for my item. She also encourages buyers to buy insurance, since she is not responsible for lost or damaged items once in transit. I realize that she sent the item, but she encourages insurance buying then does not pay for the insurance. I smell a rat, and am sick at my stomach, and without my media player. What else, if anything, can I do? My husband says I could possibly get her for fraud, since she advertises insurance, accepted my money, then failed to pay for the insurance. EBay is going to do something, but due to privacy of its members, it won't tell me what they are going to do. Does anyone else out there have any advice for me?

The UCC is a guideline and not adopted by all states. Ultimately, the seller is responsible for getting the item to the buyer in good condition no matter what. If they chose a poor carrier they can reimburse the buyer and then sue the carrier for their loss because the carrier violated a contract with the seller. The carrier will then have to prove they fufilled the terms of the contract. The carrier has no contract with the buyer only the seller. You can stop payment through your credit card. You didn't receive the goods, you don't have to pay - period. You will not be doing anything against the law.

I just had the very same thing happen to me. I still am not sure if the seller actually got the insurance which I paid for, but he told me that the insurance does not cover loss. I am still waiting for a reply from Ebay as to what steps I can take to try to get my money back, but as far as I am concerned, the seller was not at fault since he shipped the item in good faith that USPS would get it to me. The postman apparently put this 7x7 box on my front step on a day with 60 mph winds..you can imagine what happened to it. I am going to try to fight this with the Postmaster after I hear back from all other parties, but I have a feeling it will go nowhere. I think I am going to stick to buying locally and not trusting the postal service. If the seller actually bought the insurance, I have no argument with him. I would have a hard time proving that I didn't receive the item anyway. It's my word against the ignorant mail carrier who also has no common sense. Good luck. DO NOT TRUST THE POST OFFICE.

So sorry for your situation. Did you go to your apartment office and ask if the package was there? We had a simular problem and 3 months later the apartment manager called to inform us it had been in the office all that time.

It just happened to me, my seller pocketed the insurance money and the delivery confirmation shows delivered. There's nothing I can do since paypal and ebay sided with the person with delivery confirmation. Which I think is stupid because you can buy a $1000 item and they ship you an empty envelope with delivery confirmation on it then you'll lose. What I think you can do is file a lawsuit, but is it worth it? I f--king hate Paypal and ebay siding with them. I'm going to stop using ebay and paypal.

genzcop, Have you spoken to the PO and asked where this package was delivered? You need to do that. And ask your neighbors if they may have gotten it by mistake. How did you pay? Did you fund the Paypal with your Credit card? If so, then file for a chargeback with your CC company.

If you have proof you paid for insurance and the seller didn't use your money for that purpose, try a mail fraud complaint and see if that does anything for you. The dealer falsely charged you for a federal service and then deprived you of it.

I have been ripped off before so I know how you feel, and it sure does suck. I hope you can initiate some action against that seller for fraud and I hope you're successful with the chargeback as well.

Hi... I purchased a 10Q copper bottom pot in January and to this day haven't, received it. The seller and I spent about 1-2 week with our respective Post Offices trying to find the item. It was finally decided that I should ask for a refund, which I promptly did. I was told by the seller to go through Ebay. I tried doing that and was informed by Ebay that it has been over 45 days! At this point I contacted my Dicover cc company and they're handling. I just received a message from the seller asking "What I dont understand is why you think I have to refund your money when the post office lost your package. It's completely out of my hands if a package..." Firstly, if a seller feels that the USPS isn't competent to deliver their package, then they should use another delivery service! Secondly, The "I'm not responsible for a package once it's in the hands of the Post Office" doesn't does not absolve them for FTC RULES! If a seller becomes the buyer, they would surely expect their package and a refund if they didn't. Got to your CC company when you have an issue with a seller; bypass Ebay!

I'm having the sme problem for the first time ever with an eBay purchase. In this case the dysfunctional Post Office delivers our mail M-F after 5:00 p.m. but because no one is available to receive it at our Administration office, it is diverted to a second address "down the street", where there is no one to receive it either, so it then goes to some third party assistant manager somewhere at their home, to be delivered back to us the following morning for distribution. Friday's mail doesn't arrive until the following Monday. My priority mail eBay purchase shows delivery confirm but it was not to my home address. Lost of course. My only recourse is to close my eBay account and fugettaboutit. Or only deal in future with vendors willing to send everything by FedEx or UPS. Some choice! I've gone through the Post Office Delivery Supervisor but expect no resolution since it wasn't insured. I can do one thing: make sure everything I've ever had mailed as paper copies now goes "green" online only and never ever order anything via USPS. I hope the stinking Post Office goes down forever.

I think the key is you need to get a proof of you paid insurance. Was thatg done by your eBay message to the seller ? If so, eBay has to investigate that and make a decision for whether the seller violated the rule. I do believe that an insured mail will require signature and can not be left on a door step. However, if there is no solid proof or you simply requested but seller never accepted it, then you just had your bad luck. Most eBay item shippings are not using insurance and seller often advertize for cheaper shipping rate to compete. If no word of "my shipping rate includes the insurrance" then, the package can be left by your door and depending on your neighborhood, it can be stolen.

SAME HAPPENED TO ME!!! Wonder if it was same seller. Unfortunately she lied to me too about insurance. Someone stole it while I was at work to earn money to buy stuff for people to steal while at work.
No one will help you. That's how it works. Seller wouldn't help, ebay sides with seller (ESPECIALLY IF TOP RATED OR POWER SELLER because they make ebay more money) USPS won't help. You just paid for them to screw you.
Two things learned here:
1) it is OK to lie about insurance in your ad.
2) it is OK to steal from someone's porch because the cops, ebay, USPS, etc. are too fat and lazy to do anything about it.
It's not their $65 so why do they care? You can set-up fake packages and wait to tackle and assault the thief, but then you're the bad guy. Even though it wouldn't have to escalate to this if only one of the people along the line did his/her job. JUST ONE!!!

I have never heard of insurance being advertised as it only benefits the seller in case the package is lost during shipment. As long as the package is marked as delivered then it is your responsibility. It's up to the buyer to insure the item will not be stolen after it is delivered. This is common sense. The package made it to your building, Insurance wouldn't cover this anyway. Your fault.

Hi I justsent out a package with delivery confirmation they say the package was delivered but the cusotmer says it has not been recieved I filed a compliant with thie cutomer's local post office to hopefully get the issue resolved have you filed a complaint with your local one you should speak personallywith them about this I wil not stop until they locate the package for my cusotmer thank you katie wiest

This is a very old thread, but thought I'd offer some advice I've had over the many years of using USPS Priority. Only twice in 7years have buyers come back and said they didn't receive their package. Both times I contacted the receiving Post Office and was actually able to speak to either the carrier or Post Master. Both times I was able to locate EXACTLY where the package was delivered and inform the buyer of it's location. Once was to the apartment building managers office and second time to a neighbors home.

I mailed a package USPS First Class with Delivery Confirmation. USPS tracking shows that it was delivered to me (Home Address) on the very same day that the mail carrier picked it up from my mailbox. Recipient claims it was never received. Filed claim with USPS and still awaiting a reply. Any Suggestions?

Buyer always wins? It is the other way around. In 10 years, I filed 100 or more Disputes, and not 1 time have I ever got my money back. The seller always wins. That is why if I ever get scammed again by anyone on the internet, I will literally have the Feds knocking on the door. They will be having prison time. Seeing that any transaction, no matter if they are using a fake name and address, I can get every detail from them including their Social Security Number. My uncle works at the White House, as a assistant of the President.

Once the package is marked delivered you can't find anyone to be on your side. The buyer is going to say that the package was delivered as stated by the DC so she is not responsible. The PO will do the same. Ebay certainly won't do anything about getting your money back as again it was marked delivered. The only thing they might do is make the woman give your insurance money back. But consider this, even if she had put insurance on your package, once it is listed as delivered the PO will not pay off on the insurance as technically according to their records it is not lost. I am going through this right now for a $249 item that my PO put in a locker and then put the key in another PO Box. I am going to lose my item, my money because no one takes my side....not even eBay. And mine was my sole Christmas gift this year so my Christmas was neither merry OR bright.

Since you paid USPS, UPS or FedEx, they are YOUR AGENT, which means "acting on YOUR behalf". YOU are responsible for getting the package to the buyer. If you don't want to take responsibility for YOUR AGENT, you can deliver it yourself; not practical, I know but taking responsibility is practical.
