Invalid Squaretrade Warranty: False Advertising and Misrepresentation

I bought a KG800 Phone off ebay a few months ago along with the squaretrade warranty for that phone. The seller is a platinum seller and member of the Squaretrade community. On the auction, there was a link to purchase an extended warranty for the phone, a LG KG800 (the Choclate), from Squaretrade. The only reason I bought the phone was because there was a warranty being offered. Two months later and my phone broke. I contacted VAC Service Co. (the company that handles warranties for Squaretrade) to get it warrantied, and they told me they could not honor the warranty because it is a phone not intended for use in the US Market. I contacted Squaretrade and they offered to refund me my money for the warranty. I asked them why they sold me a warranty that could never be honored and they said they made a mistake and would refund my money. But the point is that they are false advertising and misrepresenting their product. Think about if 100 people buy warranties from Squaretrade that squatrade can never honor. In the end of the day, only 10 of those people's products break and when it does, squaretrade just refunds their money. But what about the other 90 people who have paid for a warranty that cannot be honored? Shouldn't squaretrade refund their money irregardless of whether or not the product breaks considering that the warranty is null and void? This is my concern and I am interested in taking a class action lawsuit against Squaretrade. I am looking for anyone with a warranty from Squaretrade for a product that is not intended for US Market use.

Any suggestions comments?

For the Palm owner. Bring your device to somebody who knew how to handle a soldering gun. Probably solder near connector on circuit board got cracked and it needs to be
resoldered. About Square Trade - people, use your brain and do not buy this spam.

Question for SquareTradeKord.

Why were the people who bought cellphones and other electronics - not designed for use in the USA - not covered by the SquareTrade coverage and simply sent a refund of the coverage cost?
Your coverage terms state: "If your item is used, refurbished, or doesn't have a USA manufacturer's warranty of at least 90 days, then the Service Agreement lasts 2 years, beginning on the 61st day after item purchase."

So shouldn't their coverage be honored and cover for two years???
If the item doesn't have a USA warrantee it wasn't meant for the US market. Conversely, if it was meant for the US market it would have come with a USA warrantee. It appears to me that SquareTrade's terms indicate that items not intended for use in the US would then have a 2 year warrantee.

SquareTradeKord here.

The SquareTrade Care Plan, as administered by SquareTrade, does provide coverage for cell phones manufactured for use outside of the US.

You are correct that most of these phones are indeed covered under our 2 year plan, as generally speaking, the manufacturers will not honor their warranties for these items.

Coverage under the SquareTrade Care Plan provides for repairs, OR reimbursement in the amount of the item purchase price should a claim be filed against an item under coverage.

Generally, for cell phones under coverage we offer reimbursement of the item purchase price as opposed to repairing. Why? Because cell phone are complicated to repair, are relatively inexpensive items to purchase, and for many people, are a necessity.

By offering reimbursement of the item purchase price, buyers have the ability to begin their search for a replacement cell phone - instead of waiting for their phone to be repaired.

People, venting here and saying "let somebody find a class action attorney" won't help. You have to move your @ss and do something yourself. Such as:

1. file a complaint with the attorney general of the state where this scam squaretrade is registered. You can find business info on squaretrade at Link , which, among other things, is also mentioning Mr. Kord Hamilton, Customer Experience Manager, and then file complaint at Link

2. file another complaint with BBB itself on their site. The above record shows that SQT have satisfactory record, i.e. they do resolve complaints that are filed.

3. sue SQT in small claims court. In this case SQT will also have to pay court costs, which makes this even more attractive.

4. find class action attorney by yourself. Again, search such as Link
helps. You don't have to find any other members of the class, that's something the attorney will do if he engages on this.

I just bought a used Panasonic Toughbook laptop on E-bay.
A 2 year warranty is being offered by Square Trade and they have e-mailed me three times promoting it, including reducing the cost of the warranty by 10%. The laptop is said to be in good operating condition, nearly pristine by the seller. Somewhere in the listing text the seller describes the laptop as being sold "as is". I did read the terms and conditions which is what led me to this forum. My question for Kord, is there any reason I should buy this warranty? Also how would you rate customer satisfaction of the Square Trade warranty redemption process on a scale of 1 to 10, in light of the dismal rating on this forum?

Hey thanks a million guys. I just bought a New Garmin c330 GPS off e-bay. Square Trade e-mailed me and offered a 3 year warranty for $25.99 I thought I better check this out so Googled it up and came here.Also went to a few more sites and all bad bad negative feedback. Life has enough stress so for sure I'll pass on this offer and take my chances it doesn't break down.

Thanks guys. I just bought an ipod nano today and was looking into buying a warranty as well... but i guess not anymore. Most of these reviews are pretty negative. My question to Kord is also... Is there a reason at all that i should purchase a warranty from Square Trade?.. and what guarentee is there that i wont face the same situation as the rest of the people still waiting to claim their money.

Look at third party warranties this way: If they were a good deal, they would not be offered. They are a huge profit maker for the companies that offer them.

Let me add this is a huge profit for any insurance company -
which extended warranty is. And this is a rules of the game.
But for this company it seems to be not enough and they
betray different ways a lot of their customers.
Well, eventually nobody is gonna deal with them and they will disappear.

Squaretrade, I am positive that you are aware of this discussion. I hope you see how many potential warranties you are not selling due to your incompetent procedures.

Thanks for being here everyone!
Just about clicked the submit button on a $32.00 Square Trade warranty for a used laptop...then stopped, hit Google and found all you wonderful people (with the exception of Kordless). Thanks for your time, sorry about the folks who got hosed and keep up the great communication! (again, with the exception of Kordless) Kordless gets paid minimum wage to have a long title and reply to posts without ever really answering questions.

I was just about ready to buy a SquareDeal Warranty, but with everything I read on the net tells me they do everything to get out of fixing or replacing anything. I cannot believe ebay would own or represent a company with such bad ...(fraudulent???) practices.

Thanks for the information I have read so far. I would like to believe Kord when he says that Squaretrade is improving, but, am not seeing that here. Unfortunately, that is because most people who find themselves here do so after being burned by Squaretrade. That does help those of us deciding whether to plunk down our money, and for that, I am grateful.
I have read the warranty policy. The used laptop I won does not have "as is" in the description. But it does say that the speaker is faulty - something that I can find a fix for online. I worry that If I fix it (open up the laptop), or worse, if the original owner opened it up, the warranty is invalidated. Kord, perhaps you could address that question?
For everyone else - is there another warranty I can get for used laptops? I don't want to go through that hassle, and if Squaretrade decides to refund my $41 (or if lucky, $410), have to wait up to 60 days to get it. I'll want a replacement faster than that.

Try Googling using terms such as warrantee and used. The ST offering may be unique. Anyone else who offers warrantees on used items is going to also have lots of outs in their terms. Just remember that the reason any company would offer such warrantees is that they intend to make substantial profit on the offering. With the requirements of shipping items for repair, any money saved on such agreements is going to be quite small. Check around your area and see if you can discover who covers the service contracts on such items in your area. You might be better off buying a service contract locally than doing so online. I frankly don't think either extended warrantees or service contracts are worth their cost. Both are tremendous profit centers for the companies that offer them.
