Invalid Squaretrade Warranty: False Advertising and Misrepresentation

I bought a KG800 Phone off ebay a few months ago along with the squaretrade warranty for that phone. The seller is a platinum seller and member of the Squaretrade community. On the auction, there was a link to purchase an extended warranty for the phone, a LG KG800 (the Choclate), from Squaretrade. The only reason I bought the phone was because there was a warranty being offered. Two months later and my phone broke. I contacted VAC Service Co. (the company that handles warranties for Squaretrade) to get it warrantied, and they told me they could not honor the warranty because it is a phone not intended for use in the US Market. I contacted Squaretrade and they offered to refund me my money for the warranty. I asked them why they sold me a warranty that could never be honored and they said they made a mistake and would refund my money. But the point is that they are false advertising and misrepresenting their product. Think about if 100 people buy warranties from Squaretrade that squatrade can never honor. In the end of the day, only 10 of those people's products break and when it does, squaretrade just refunds their money. But what about the other 90 people who have paid for a warranty that cannot be honored? Shouldn't squaretrade refund their money irregardless of whether or not the product breaks considering that the warranty is null and void? This is my concern and I am interested in taking a class action lawsuit against Squaretrade. I am looking for anyone with a warranty from Squaretrade for a product that is not intended for US Market use.

Any suggestions comments?

I'm sorry for your upset.

SquareTrade covers hundred of thousands of electronics items sold by eBay sellers.

The process of correctly identifying items depends largely on each seller properly categorizing the items they are listing (both by listing in the appropriate category, and by completing the rectangular "Description" box located directly above the larger free-form item description area).

I've seen several instances of sellers listing an item as "Used" with the rectangular "Description" box and further adding "As is" within the larger free-form description area. Using this example - our system would only be able to recognize the formal "Item Condition" of "used", not the free form addition of the term "As is" in the larger item description area.

Unfortunately we cannot individually review each item listing to ensure that it fully meets our terms and conditions before sending our "Warranty Available" email notifications.

It is importan to note that we do cover some "As is" items. “As is” is generally used in 2 ways by sellers. You’ll need to read the item listing to determine which one best describes your item.

If the item is described in the listing as “non-functioning”, or is being “sold for parts”, or has not been tested, then we will not cover it. Generally, sellers will not offer a return policy on these items either.

If the item is described as being fully functional and the seller offers a return policy if the item doesn’t work, then we will cover it.

Rest assured, we are currently working to improve/refine this process.

I have purchased Square Trade Warranties for several items, new and used, some purchased on Ebay and some purchased at Walmart and even a few cell phones from the T Mobile store. I have had great success with the service. I have used it twice. My cell phone quit working a year after mfgrs warranty was up. I filled out the online claims form and they called me within a day or two. Square Trade sent me a mailer to send the phone in to them. They determined it was unfixable and within a week I had a check for the full amount I warranted it for... $300

I also bought a warranty on the iPod I bought on Ebay. When I sold the ipod before christmas on ebay so I could buy an ipod touch the fact that I had a transferable warranty made my ipod sell at top dollar. I transferred it right over to the new owner, no problem

My motto is "when in doubt, call them up". I always call before I buy anything over the internet. If they don't have customer service numbers listed on the website I don't buy from them. SquareTrade has customer service toll free lines and I use them. They are always polite and helpful. They even file a copy of your receipt with your paperwork so it is available in the event you need to make a claim. This is good for several reasons. One, I usually can't find the receipt when I need it so I send it to them so they can keep up with it. And, two, it gives them a chance to look at the receipt and make sure the item is eligible for their service.

I would suggest, like any other legal contract, read the details carefully before you sign up. There are always going to be exclusions. Maybe they need to make the exclusions more prominent on their website.

Sorry you are having problems, but I have to say I have been nothing but happy with SquareTrade, up to this point. I currently have 5 of their warrenties. I am purchasing 2 iPods for Father's Day gifts and I will be warranting them through Square Trade, too.


If you ever need a hard drive replacement for any of those ipods, buy it from our company... we offer extended warranties too... AND WE ARE THE ONLY COMPANY ON EBAY WHO DOES, AND WE ADVANCE-SEND/REPLACE THE ACTUAL ITEM... SAME DAY !

Maybe you should stop reading in to what they said when they said they made a mistake. Perhaps, they didn't have that phone setup on a list that can't be used with their warranty system. Do you know how many phone types there are in the world? 1000's and 1000's of them.

You go for your class action suit, make sure you have a ton of money on you and make sure you read the policies they have real careful before you go opening this can of worms.

Also get an attorney before you make any decisions because if you loose Square trade attorneys are going to sue you for any damages they feel you may have caused with your lawsuit.

*THIS* is a REAL hard drive extended warranty... read it folks... SquareTrick won't even compete with it... in fact, get this... after many calls from them begging us to promote them, (before we knew what they truly were) we told them we would be happy to promote them, provided they used our company for their extended warranty customers for hard drives, as we are the most respected hard drive seller on ebay and a TOP RATED SELLER. Their response was, and I quote directly... "we do not replace or repair defective items or items that fail to customers... we refund the premium". I should have recorded the conversation.

Thanks for this info. VERY helpful! I just bought a phone and was offered a warranty through Square Trade too. They make it sound so great- full refund on phone if they can't fix it, etc. I don't have the phone yet, but my guess is that it wasn't meant for the US market either. Guess I won't bother shelling out more money on this. Thanks!

I just bought a phone as well, haven't recieved it as of yet. But i won't be purchasing the warranty. It really is disgusting that ebay lets them get by with fraudulent business. I'm going to be over the top upset if my phone 'breaks'. So could some clarify to me that with my 100 day warranty through the seller, how much coverage do i truely got. Should i return the phone up receipt and do business elsewhere?

I could not be happier will Square Trade warranties. In Dec 2007 I purchased an ipod and took out a warranty. Two years later it cratered. I communicated with Square Trade not knowing what to expect. I was treated nice and communication was A+. I was told what my options were. After sending my ipod into Square Trade I received a refund to my paypal account within a couple of days after they had their technicians inspect it. Based on my experience I would recommend them to any one. My new ipod will be here this week and as soon as I have it in hand I will purchase a warranty for it through Square Trade.

OUR COMPANY SELLES REAL, LEGAL AND LEGITIMATE EXTENDED WARRANTIES FOR HARD DRIVES AND WE ADVANCE REPLACE THE SAME DAY A CUSTOMER CALLS WITH A PROBLEM... NOT THE BS FAKE, FRAUDULENT, MISREPRESENTED WARRANTIES BY SQUARE TRADE, BUYSHIELD AND THE REST OF THEM.



Hey DIS, why don't you stop posting here? All your doing is providing confusion for users and offering your competing services. If i had a warranty business, yah i'd try to bash the competition especially if they're better than me. Otherwise why would you try to be bashing them so much? You want to seem to be "fighting" for everybody but you just want to know how your the best...


Just bashing this company shows me the type of company you are, and i would NEVER purchase anything from the likes of you. To state to someone to quit their job and work for a pet food place? Oh yah that's very business-like. Proves to me how much of a true business person you are.


Also why would AMAZON.COM sell the warranties if they are not legit? People are taking the easy way out and blaming the 'insurer'. If you purchased life insurance and it specifically said "in case of suicide we will not pay out" (like most of them), do you think you can sue them for that? NO because people don't read the information provided to them. Most people just pass thru the Fine Print but that's the legally binding contract. You agreed to it.

Please explain why does the BBB have a rating of A+ for their business? That's because only a small percent have an issue but it's that percent that are making a big stint of this. You think someone that likes this company and has success would just go out and find negative feedback just to add their good comments?
If everybody has an issue, go to the BBB (as a third party) and see what happens. If the BBB doesn't agree with the settlement then they wouldn't be at A+. Obviously they must agree that the people buying this should read the contract before agreeing with it.
