I recently purchased a collectors poster. Even though the seller said he would use a poster tube the item was sent in a long shipping box. The seller had insurance. We agreed on an arrangement where he refunded half my money and he sent me another item he had for sale. He didn't have an exact replacement. He said he would file the insurance claim on the poster. I took the poster to the post office and spent $7.50 on shipping and delivery confirmation. Not five minutes after I left the post office the seller told me not to send the item back as it would void the warranty. He told me to keep the item until further notice. I hurried back to the post office and was able to get the item back, but they said they could not refund the money. Two weeks later the seller instructs me to send the item back now that he has the insurance money as he wants to resale the item at a discount. My question is since he got the insurance money back do I still have to send the item back? I will be out double shipping. He also told me I could keep the damaged poster if I sent him an extra $25 bucks.

If he got the insurance money, then he was paid for the item and you should not have to return it, nor would I compensate him the 25.00 for the piece.

 

If he did not get full insurance to cover the entire cost of the item, that's on him.

That's what I was thinking. The insurance made him whole.

I would be nice yet honest with the seller. I would explain that when this first happened you tried to return the item and paid $7.50 in postage only to have him write you and tell you not to ship it back yet, so you were out $7.50.

 

Now, he's asking you to ship it back again. Who's going to pay for all this postage?  If he's willing to give you $14 as a refund fine, but he owes you for return shipping. Sadly, due to his flip flopping... twice.  He should understand if you explain it like this.
