New Law that will do away with selling ANY child item new or used

Ok, so this isnt so much about feedback, but I wanted to hear what some of you guys think about this new law taking effect Feb 10th and then Aug 10th any seller that wants to sell anything related to a child has to have their items tested by a certified lab. This cost starts at $50,000
This new law is for new and used items a like. Toys, books, sports equipment, clothing, custom made clothing and accessories, shoes, jewelry, etc... ANYTHING geared for a child.

Selling a child's item with out having it lab tested is a felony!

I read through the bill, and it is one of the worst I have ever read as far as spelling out the scope of the law. Most of the bill seems to be directed toward manufacturers and private labelers. IMO saying that thrift stores and garage sales will be banned from selling children's items altogether is premature. The section dealing with toys is very problematic, but the section dealing with clothing seems to put the responsibility on the maker. I think that, if anything is actually done to stop the sale of used clothing in resale venues, it will come down to a court decision.

What a PITA!

It would make more sense to just stop importing child items from China. I read a report last year that virtually all the items that contained lead and toxins were produced in China, and that the products were bbeing imported at records highs. It doesn't make sense that we would do business with a country that doesn't even like us, only to let the country poision us slowly.

When you think about it, it a pretty good plan for China ( a growing super power): Poison the young of the reigning super power (the U.S.). The ones that don't die stand a good chance of brain damage. After a generation or two, we become a mentally handicapped cpuntry. Who know, it might be a new form or warfare.

I'm good enough. I'm smart enough. And, gosh darn it, people like me.

The responsibility of the maker to have it certified lab tested? I dont know, I cant decifer the law in any great detail, but it sure does seem that resale and custom makers are in some trouble.

I'm not even sure how to respond to this because the law is incredibly confusing. Also, I don't think Ebay has made any annoucements warning users of changes in the children's clothing and toys catagory.

Though from what I read it does seem to be primarily directed at clothing, not so much at Toys which are already banned if they have been or are recalled.

I also can't really tell how appicable this is going to be on Ebay sellers, only time will tell. Due to the fact that the law is so unclear on how far reaching it is, I don't think Ebay will do/enforce anything until ordered to do so by a court.

I say let Gaza and Israel, Iraq, and all those other countries like Libia, Palastan etc etc bomb the hell out of themselves and let it be over with I'm tired of it all!.

What concerns me is that it is a law for 3rd party sellers, which means resale, and of course custom made items (because they are made from already purchased items). This government is gonna regualte us right into becoming Nazi Germany if the people dont start taking notice and start sqwauking a little. I dont like being told what I can and cant buy. I purchase a lot of my daughter's items from Goodwill and have since she was born. I am just frustrated. I live in Ca and just recently learned that new Green laws going into effect will also shut down a lot of our businesses here and this state is already in dire straights financially. WE THE PEOPLE need to take our power back some how.

What angers me about this is that the toys and clothes, and materials that are used to craft handmade/homemade items should never get past the manufacture without having been tested in the first place. Passing the cost and responsibility onto the consumer purchasing any or all of the aforementioned is just plain moronic!

Why on earth should consumers be responsible for ensuring the safety of items purchased, and forced to pay the heavy cost of lab analysis?? This is the most ridiculous thing I've ever heard of.

All of these costs should be imposed on the manufactures of said items. Not the re-saler or crafter. You want to manufacture buttons, clothes or toys? Don't used lead based materials in the first lace, and ay the cost to test the materials or be banned from production, period.

Exactly Sarah. This law is idiotic and is gonna have a tremendous affect on the poor that rely on resale and goodwills. I am just shaking my head. But "we the people" can change the laws if turn out in masses to protest. Otherwise the government does exactly what they want to do. And from the looks of the economy, that isnt such a great idea. Putting the fox in charge of the hen house.

It's rather simple folks, the manufacturers will have the items labeled as having passed inspection, so if they are resold, they will have to have the tags proving that they've passed.

For custom made items, the only requirement on the maker would be to prove that the materials used had already been tested. The only thing the maker would be responsible for, would be any materials (glue, paint, embellishments) added by them.

While most are feeling that this is overkill...kind of like swatting flies with an H-Bomb, would you rather have just take the chance and have YOUR children be the guinea pigs? Of course a few thousand babies born with birth defects don't bother most of you.

This law is idiotic and is gonna have a tremendous affect on the poor that rely on resale and goodwills.

The charities and clothing banks will be granted an exemption, just as they currently are concerning food.

The law doesnt state that as of yet, but people are lobbying for the amendment. I read on website that stated the law cant be amending in time before it actually took effect and will hurt the charities if not amended very shortly.

What are the statistics on birth defects from lead in toys that have been around for decades?

That is what the law was originally aimed at.

The fact of the matter is, the crafter should not have to pay $4,000 out of pockets to sell a quilt iffens the materials they've used aren't tested by the manufacture.

Items that are not tested and passed BY THE MANUFACTURE, should NOT be on the shelf in the first place! Period!

If manufactures aren't willing to pay the costs, put them out of business, not Goodwill's, crafters and small time resalers! Simple as that.
