seller trying to bully me to remove feedback

A seller sold me a pair of pants 2 months ago.
I knew coming from thailand it would takes some time to
recieve the item in the states. I gave it almost 2 months.
At that point I placed negative feedback and contacted
the seller at the same time. I honestly didnt realize
that negative feedback was so hard to have removed or
edit but either way 2 months and something was going on
and negative feeback was how I thoaught you contacted the
seller.

Now the seller sent me a note saying
it was too bad I didnt contact them first or they
would have been glad to send a replacement or refund.
Now I read that and had to send a reply to clarify if they
really meant they were admitting fault but refused to do
anything because of my use of free speach. They
confirmed they would not send a refund unless I removed
feedback. That seems like theft to me.

Ebay wont open a claim because I waited to long. Part of the
problem there is that I work long shifts. Usually around
2 weeks out in the field and then I get back. Seems like
the ebay system may not work in my favor to deal with
such issues. Any suggestions for what I should do? Seems like something should work since they admitted they did not send it and have asked me to remove feedback in order to recieve something they have recieved money for. But due to my schedule and giving more then adequete time to send it I have past the 45 day limit for ebay and paypal.

I would be glad to update feedback to say it was resolved although I am feeling less generous since I am feeling bullyied into doing it.

Should never use feedback as a means of communication

So why didn't you contact them first??

JLH is correct in that you should NEVER use feedback as a form of communication.

You have 45 days in which to file a Paypal claim and 60 days in which to leave feedback. Sounds like you don't know that, but at least you know it now, going forward. By leaving a negative for your seller, you have removed any and all chance of him working with you to either replace the pants or issue you a refund. You can, however, contact your credit card company and see if you can get your dough back that way.

Two weeks on, two weeks off, leaves you plenty of time to file a claim with Paypal in the future.

Should you accept your seller's invitation to change the feedback, you may get your money back. You may not. It depends upon how trustworthy he is.

If you paid with a credit card via PayPal, call the card issuer and start a charge back.

Dude - you negged the seller (I don't blame you for the neg - but you should have contacted the seller 1st) ...

And you're surprised they're unwilling to help you now - after so much time has passed?

Feedback is not the way to communicate. You should have contacted the seller, filed appropriate disputes/reports if no help forthcoming - 1st.

and negative feeback was how I thoaught you contacted the seller.

Really? Even with the "contact seller" links on the auction?

Where did the seller admit this? In their email they simply told you they would have been happy to send a replacement (i.e. - item might have gotten lost in the mail) or a refund - if you had given them the opportunity.

At the two month line, either you post the neg or not.

Posting the neg keeps the transaction open, since seller can fix the transaction in exchange for the neg being modified.

If OP had not posted the neg, the transaction would be closed.

Yes, we'd like to know what happened to DC, if any.

Yes, maybe seller could have gotten one shipped soon if asked.

But also yes, buyer had to post the neg to maintain any rights at all.

Sure, but not as the first choice as communication. Why not tell the OP they should have emailed the seller first? Why encourage buyers to leave negative feedback when there are clear and better alternatives.

They didn't admit to not sending, they just said they would have worked something out if you had contacted them. Tell them you want half of your refund up front then you will revise. So many people get refunds then never revise feedback that you have to see from the sellers side too.


For future reference, when buying from out of country as the seller if the offer insurance or confirmation. If you don't receive the item in 4 weeks, contact the seller. I've ordered from overseas quite a few times and most things from asia take 14-20 business days.

If we're to review the history of this case, the #1 thing which was missed was filing an INR dispute before 45 days.

I think this be a new thread started by the OP. I thought I read that there was an e-check involved and the seller didn't ship the pants because they were never notified that the e-check had cleared.
