I found the story... 1) The person was an employee of a company and was using a pseudonym to post on the Yahoo Finance bulletin board in support of his company over a seven-year period, and...

2) The FTC took no action against this person... the FTC's involvement was limited to exposing the person's alias in the footnote of a court document filed by lawyers for the Federal Trade Commission, which was trying to block Whole Foods’ acquisition of Wild Oats on the grounds that it would limit competition among natural and organic groceries.

Sandy do you remember the court case where I said the court made PayPal change their policy and you said the court didn’t?

The court in fact did make PayPal change their policy, eliminating all the linked pages \ information but I let you have that one figuring people were a little smarter and would big into the case a little deeper…

What was that case anyhow… it’s been a while. :)

That person was posting under an alias talking smack about a rival company and takling up the company he worked for.

There was a court case a couple of years ago about a blog poster posting lies on a blog. that poster was sued for libel and lost in court.

His defense was that it was a blog (posting id).

Do you really expect the FTC to enforce eBay's rule which states that eBay employees must disclose in their eBay listings that they are an eBay employee?


who had had to file suite and presure Wholefood's into disclosing who the employee was? Why the FTC of course.

That is not correct... the FTC was trying to block Whole Foods’ acquisition of Wild Oats on the grounds that it would limit competition among natural and organic groceries. The revelation of this executive's posting ID occurred in a footnote of a court document filed by the lawyers.

That was it... the executive's posting ID was revealed... there was no action taken by the FTC, SEC or Attorney General against the executive.

All of the above, which could maybe have some insider trading implications, is a FAR, FAR cry from an eBay employee failing to disclose their eBay employment in an eBay listing.

PayPal customers who sued the online billing company, charging that it illegally froze their accounts, cannot be forced into arbitration to settle the dispute, a federal judge has ruled.

In a ruling dated Aug. 30, the U.S. District Court for the Northern District of California denied PayPal's motion to have the claims asserted in two lawsuits resolved by individual arbitration, the company said in a regulatory filing on Thursday. Although PayPal's user agreement calls for the arbitration of disputes, U.S. District Judge Jeremy Fogel ruled that the arbitration clause in the agreement is unenforceable, PayPal said. Though the online billing company said it could appeal the decision, it did not say whether it would.


I wonder how this case ever turned out?

I’ll dream tonight that all those people how filed law suits on PayPals questionable acts just to have the case dismissed via Breach of contract will be given a new chance to be heard… wouldn’t that be nice. :)

Deceptive practices in business violate the FTC Act. The FTC Act defines a deceptive practice as one (1) that represents or omits information that would likely mislead "consumers acting reasonably under the circumstances" and (2) "that representation or omission is material to consumers."

It applies when a service is involved as well as for the sale of products.

timstiques, It seems you got lost in all the hyperbole? The allegation was that the FTC had to remind Lorrie Norrington to clean up her auctions because she didn't disclose that she was an eBay employee in the auction.

timstiques, Where do you find any credible news source which indicates that the FTC did this?

You are correct on this. The FTC permits all types of anti-competitive combinations to proceed to fruition unchallenged, but takes official umbrage at some hippie type trying to corner the trail mix retail market.
