Good evening! My name is Elias Hatoun and I am pleased to host this important workshop. In addition to being an eBayer for almost three years, I am also a Gemologist with twenty five years experience in buying and selling new and estate diamonds, at the retail and wholesale levels.

I will be discussing mostly single diamonds in the one half-carat to three carats range, with emphasis on how to pick a seller with the proper qualifications and refund policy, the questions to ask to avoid misgrading and misrepresentation, and how to verify the quality and value of your diamond once you receive it.

Just like anything else traded on eBay, you can find quality diamonds at good prices. However, since no one (including diamond experts) can identify a diamond bargain with certainty over the Internet, I will advise you on how to exercise caution to avoid making a costly mistake.

A previous workshop entitled "Understanding Diamonds" has dealt extensively with "factors of value", "certificates", "purchasing tips", etc. It is now in the workshop archives, and I urge you to read it for a good basic understanding of diamonds. I will not be going over the information provided in that workshop, except when it relates to my comments.

PROTECT YOURSELF...

Since you can't see the diamond,if the seller does not accepts ESCROW payments (most sellers don't), you should consider buying from a seller with an excellent feedback record, preferably for transactions related to jewelry, and who offers a full and prompt money back guarantee, no questions asked. Yes, you should be able to return it for any reason - or for no reason at all - within a reasonable time period specified by the seller (preferably at least one week - five business days - from day of receipt), without any hassle, and without incurring any restocking fees. After all, most physical jewelry stores offer this unconditional money back guarantee AND you can examine the diamond before buying it - therefore, why should you not have the same privilege when buying a diamond on eBay?... where in most cases you have to pay first, before you have the chance to examine the stone! Notwithstanding the time limit imposed by the seller, if the seller is a dealer, you may have rights under the law, especially if there is misrepresentation (willful or unwillful), or failure to disclose information, like treatments, enhancements, etc., subject to the statute of limitation in your state. If you feel the diamond has been misrepresented, and can't get satisfaction from the seller, check with your lawyer and read the Federal Trade Commission rules on jewelry; they are available from eBay.

PAY ONLY WITH A CREDIT CARD.

To insure that this guarantee will be honored, you should pay ONLY with a credit card, even when using on-line payments like Billpoint or Paypal. If there is a problem with the refund, you should contact your credit card company IMMEDIATELY and explain the situation; they will investigate, and if they determine that you are right, they will reverse the charge on your account and charge it back to the seller's.

Never agree to buy a diamond "AS IS" , "NO REFUNDS", "EXCHANGES OR CREDIT ONLY" etc., and never agree to have any of these statements imprinted on the charge slip! The sellers have the right to their policy, but you don't have to buy from them! .. Unless you enjoy taking risks! In the " sight unseen" diamond business, you would have better odds - and more fun - in Las Vegas!

Unless you trust your seller, if you are buying a diamond of high value, you really should try to buy it unmounted, especially if it does not have a Grading report from a major Laboratory. The reason is that the appraiser you will take it to after the sale, will not be able to verify the weight, color and sometimes even clarity, with accuracy when the diamond is mounted.

WHAT TO ASK THE SELLER

Notwithstanding the above precautions, you should, of course, try to figure out what you are getting before the diamond is purchased, to avoid wasting your time and the seller's. Inquire if the sellers guarantees their grading for weight, color and clarity, and if you would get your money back in full, if the diamond can be shown by a major Laboratory (preferrably GIA's) to have been misgraded or misrepresented (willfully or unwillfully).

On expensive diamond that don't come in with a grading report from a major laboratory, the best way to do this is to ask for a written answer to this simple question: "Do you I get my money back in full, if your grading does not measure up to a GIA Gem Trade Laboratory grading report?". Of course, a time limit for obtaining the report should be agreed upon, but not less than two months.

GIA grading reports for diamonds of a carat in weight is about $200.00; for five carats the price is $600.00 and they don't give out valuations. GIA now offers an abbreviated - and less costly- report; I believe it is called "Dossier" (same as the full report minus the plotting of the stone) for diamonds under one carat in weight. For information about their services, visit their website at www.gia.edu . Other laboratories are less expensive, but not as prestigious, and sometimes not as accurate (see below)

WHEN YOU DEFINITELY NEED A "GIA" GRADING REPORT

If you are buying a diamond of over a carat in weight that has a high color grade (colorless D-E-F) and a high value, you should definitely be discussing a GIA Diamond Grading Report. GIA's GEM TRADE LABORATORY is the only Lab that is able to identify the High-pressure/ High-Temperature (HPHT) treatment developed by General Electric a few years ago. The treatment mainly renders Type IIa brownish diamonds colorless. By special arrangement, each diamond over one carat in weight that has been subjected to this treatment is submitted to GIA for examination and laser inscription. To my knowledge, the GIA lab is the only only lab that would be able to recognize this treated diamond, should the inscription be subsequently remove by an unscrupulous dealer

Getting a GIA report is also recommended for all valuable diamonds because, unfortunately, the competition between grading labotatories has given rise to inconsistent grading, especially with color grading. On a large and valuable diamond, a difference of one color (or clarity) grade could mean a difference of thousands of dollars in value of GIA invented the grading system that everyone now uses, and they have a reputation for accuracy. They now have an abbreviated - and less costly- report (same as the full report minus the plotting of the stone) for diamonds under a carat in weight. DIAMOND TREATMENTS MUST BE DISCLOSED

Make sure you are not buying a treated diamond, unless of course you agree to it, prior to the sale. The following treatments (or enhancements) MUST be disclosed by the seller: Clarity enhancement by Laser drilling and by Fracture filling; color enhancements by irradiation and by HPHT. If you discover that you have purchased a treated diamond without disclosure from a dealer, you are entitled to an immediate full refund - and an apology, regardless of the time limit for refunds imposed by the seller. In fact, in the past, courts have awarded punitive damages for triple the amount of the sale (in addition to reimbursement) in cases involving undisclosed treatments.

A CUT ABOVE Cut (proportions, symmetry and polish), not to be confused with shape, is a very important factor in diamond grading. It is the most difficult factor to assess; it affects it's appearance and it's brilliance, and therefore it's value. Here is a quote from the Rappaport price guide, which is the most widely used in the industry. It refers to fancy shapes diamonds (all shapes except rounds), but it can be applied to a lesser degree to round brilliant cut diamonds: " Fancy shape diamonds are more complex than round diamonds and much harder to valuate. The quality, of cut, proportions, and the overall shape of the fancy shape diamond all have a great impact on price and liquidity. POORLY CUT STONES MAY TRADE AT SUBSTANTIAL DISCOUNTS, while well shaped fine cut stones may trade at a premium. There is also a higher degree of availability difficulties in the fancy market and you may have to pay significant higher prices for a select fine stone. Matching stones may also require a premium. It is not advisable to trade diamonds solely on the basis of the grading report. All stones should be examined by an expert. consumers are cautioned to consult with a reputable jeweler to avoid buying a poorly cut, treated or misrepresented diamond..."

Also, ask if the diamond would be considered by an appraiser to have a good cut? If you are buying a brilliant cut diamond from a knowledgeable seller, ask if they know the AGS cut-grading of the diamond (grades are from zero to ten, zero being the best and ten the worst)

IDEAL CUT.... IF YOU WANT ONLY THE BEST! The American Gem Society (AGS) now allows the following ranges for it's best cut-grade (grade zero) : Table percentage: 52.4% to 57.5% . Crown angle: 33.7 degrees to 35.8 degrees. Pavilion depth: 42.2% to 43.8%. Also, the Girdle Thickness can be thin, medium and slightly thick, and the Culet can be pointed, very small, small and medium to qualify for the zero cut-grade.
For fancy-shaped diamonds (all shapes other than rounds) there is also a preferred "Length to Width Ratio" range and symmetry factors that have been determined to affect their shape appeal.

WHEN YOU RECEIVE YOUR DIAMOND

Do not rely on the seller's appraisal. Any appraisal should be done by an uninterested third party. Take the diamond ASAP to a reputable jeweler or appraiser in your area; time is of the essence, especially if you only have a few days to return the diamond! The appraiser should be a Gemologist (GIA) or a Diamond Graduate (GIA). This is important, as they will be able to verify the grading provided by the seller and to identify any treatment.

Do not tell the appraiser that the diamond was purchased on the Internet, nor how much you paid for it, especially if they are also in the business of selling jewelry. Retail jewelry stores have a lot of expenses, and cannot afford to sell their diamonds for the low prices offered by a dealer operating from his office or home. Unfortunately,sometimes this could impact negatively on an appraisal.

First ask the appraiser to verify all the information and grading provided by the seller, in addition to providing a valuation. Then ask the appraiser or jeweler what the diamond would bring if you tried to sell it to a dealer in your area. A good rule of thumb is that if you get offered a minimum of 50% of the price you paid on eBay, by a dealer engaged in purchasing jewelry in your area (not a pawn shop!) consider yourself lucky; you probably had a good deal! If you get offered a quarter to a third of what you paid, you probably paid full retail, and you should have gone to the mall!
