Sellers need to start filing reports with Postal Inspectors when eBay issues start looking criminal

There are cases where eBay fails so terribly that issues with buyers and eBay begin to look criminal. 

I highly recommend that people start filing reports with Postal Inspectors at https://www.uspis.gov

when they feel this is the case.

Filing a report for what? All eBay does is provide the seller a way to get a label. They have nothing to do with the sending of the items. That's between the buyer and the seller.

Fraud is fraud, and eBay is facilitating buyers getting refunds on delayed or resent items THAT ARE VISIBLY TRACKING AND REFERENCED WITHIN EBAY SYSTEMS, that is fraud.  EBay is doing NO due diligence and the buyer is getting a refund AND the item.  

 

The buyer KNOWS the item is on the way.  They okayed a replacement AND have a new tracking number, but playing a broken support system, they got their refund today and they’re going to get their item tomorrow.  EBay KNOWS the item is on the way AND they can see relevant buyer and seller communications, but somehow their support systems are so broken, they refund the buyer.

 

Forget the “sue eBay crowd”, there are plenty of options for eBay users, the least of which are all the other platforms.

Why would a buyer 'agree' to a replacement? That sounds like they opened a 'return for refund' due to 'non delivery'? 

 

You really need to spell out what happened to get any good feedback.

 

 

Either way, ebay has NOTHING to do with USPS shipping. If tracking shows the item delivered, buyer is out of luck as long as seller responds to the 'refund request' by inputting the tracking number. 

 

If seller 'messages' the buyer and sends another one- that is 100% on the seller and that is NOT how it works.

Mail fraud is a federal offense in which an individual uses the United States Postal Service or a private carrier to commit fraud. The fraud can be to either obtain money or property under false pretenses or distribute counterfeit funds. While private carriers are not owned by the government, it is still illegal to use private carriers, such as FedEx or UPS to commit mail fraud. 

Any form of mailing something in the act of committing fraud is categorized under mail fraud. This might mean mailing invoices or receipts.

However, for the crime to be prosecuted as a federal crime instead of a state crime, the mail must cross state lines. Mail fraud includes items sent from one state to another. In such cases, the offense falls under the Commerce Clause in the Constitution, which states that the offense is then in federal jurisdiction.

yes.  correct.  This was done.  The new tracking number was “in the system”.  FYI I’m not looking for help here, this post is expository.

I would agree that after a carefully scripted message to a BUYER that filed a SNAD claim for "empty box", the report idea is most beneficial.  Just mentioning to said buyer that 'I was truly dismayed that the box arrived without the contents, and I would gladly aid in the recovery of the product by filing such a report on their behalf'  typically produced MIRACLES in suddenly found product. 

That tactic is basically useless with those international buyers that use freight forwarders, however.

If the tracking has shown movement within the past several days then the INR case will be automatically extended to give the item time to be delivered. I had this happen on a whole bunch of packages during the 2020 Christmas fiasco-- I ended up not having to refund a single one of them because while they were delivered late, the tracking showed that they were still making their way through the system rather than actually lost.

Not entirely.

You can demand that before refunding, the buyer return the shipment to you. Original packaging (with or without the disputed contents). And you can do this even if you have No Returns policy. You will likely have to provide a Return Shipping Label.

 

EBay (tyler@ebay) has confirmed that the Return Shipping Label only has to go to the US address of the freight forwarder. If the buyer doesn't send anything, because that's not the forwarder's contracted obligation nor is he going to re-ship at his own expense to the forwarder or the seller, the seller wins.

Now -- if the GSP is not involved, but the buyer uses a freight forwarder, does the seller provide Return Shipping from the forwarding address or from the buyer's address?
Oooh this is a good clarification question...! A seller is only required to provide return shipping from the buyer's input address at time of checkout - that goes for any return where a seller provides shipping ('free' returns, etc).

When you upload tracking that shows DELIVERED and buyer gives eBay a song and a dance and Ebay rules in Buyers favor, YES eBay is complicit in the mail fraud and should be part of the report to USPI. These eBay rah rahs seem to never have been jacked by eBay. They must not sell very much.

The only way that happens is if the seller screws up and doesn't follow ebay  procedures.

Would you mind be more specific.  There are a variety of reasons as to why something may have gone wrong during the time the carrier has the package.  What exactly are you speaking to.  Not everything is the same when it comes to this subject.

 

Ebay has extremely good seller protection for INRs as long as the seller follows the rules.  But of course if the seller doesn't then of course they aren't going to be covered.

Ebay displaying the tracking on a package is a "fraud"???  How does that work?

 

As long as you the seller follow the rules of Ebay, Ebay has fantastic seller protection on INRs.   But you have to follow the rules and that isn't hard at all.
