Invalid Squaretrade Warranty: False Advertising and Misrepresentation

I bought a KG800 Phone off ebay a few months ago along with the squaretrade warranty for that phone. The seller is a platinum seller and member of the Squaretrade community. On the auction, there was a link to purchase an extended warranty for the phone, a LG KG800 (the Choclate), from Squaretrade. The only reason I bought the phone was because there was a warranty being offered. Two months later and my phone broke. I contacted VAC Service Co. (the company that handles warranties for Squaretrade) to get it warrantied, and they told me they could not honor the warranty because it is a phone not intended for use in the US Market. I contacted Squaretrade and they offered to refund me my money for the warranty. I asked them why they sold me a warranty that could never be honored and they said they made a mistake and would refund my money. But the point is that they are false advertising and misrepresenting their product. Think about if 100 people buy warranties from Squaretrade that squatrade can never honor. In the end of the day, only 10 of those people's products break and when it does, squaretrade just refunds their money. But what about the other 90 people who have paid for a warranty that cannot be honored? Shouldn't squaretrade refund their money irregardless of whether or not the product breaks considering that the warranty is null and void? This is my concern and I am interested in taking a class action lawsuit against Squaretrade. I am looking for anyone with a warranty from Squaretrade for a product that is not intended for US Market use.

Any suggestions comments?

Thanks for this info. VERY helpful! I just bought a phone and was offered a warranty through Square Trade too. They make it sound so great- full refund on phone if they can't fix it, etc. I don't have the phone yet, but my guess is that it wasn't meant for the US market either. Guess I won't bother shelling out more money on this. Thanks!

I bought this warranty for DVD palyer. 25 bucks value of player, 8 bucks value of warranty for 2 years. In a year DVD failed. It took me about a month waiting and about 8 phone calls just to ignowledge that my claim is valid and i need to send a player to them. Cost of shipping 11 bucks. It took another month and multiple phone calls to tell me - yes it's broken and they will send me a check for 25 bucks. It's 5 weeks passed since that I still waiting for money, calling them regulary and get promices that I'll see my money soon. Resume - really bad deal.

Yea the company they contract out to service their stuff is notorious. But anyways the thing is if a company sells you a warranty and the item breaks they can't just say sorry and refund you the warranty price that's illegal. I would LOVE to do that to my customers that purchase a 3 year warranty for an extra $14 on a $100 item that breaks, but instead I must refund them the $100 for the item or repair/replace it. They either need to fix your phone or refund you the purchase price of it. If not take it to small claims court, no lawyer needed, in many states $20 or less to file, and the chance squaretrade will show up for court is zero to none.

I am going through the exact same thing right now.
Bought a phone this last June that is no longer working correctly. I had the extended warranty through Squaretrade so gave them a call. The phone turns out not to be intended for use in the US and they cancel my warranty on the spot. Hardly seems legal at all.

So in other words even the sellers who refer you to squaretrade should be liable for offering false information! I was just about to buy the warranty but I am one of the biggest skeptics of insurance and thought of researching a bit. Good information - I can see class action n Square Trade very soon.

I have spent a few hours trying to see if the Squaretrade Warranty was valid. Now I won't be caught up in the same trap. I bought a Kodak Camera and was offered the Warranty..I usually always buy the insurance on electronics when I buy at Best Buy..Thanks for saving me some money.

This information should be upfront at Ebay and the company unable to offer anthing through Ebay.

Ok let me Enlighten everyone on what i found out... Square Trade warranties under 350... its not worth fixing the item so they give you a "cash compensation" so thats the price of the unit. and i'm sorry if you ppl cant read terms and conditions... but to me if a product cant get be used in USA the problem is the seller not telling you that not the company that does the extended warranty.

I just purchased an expensive 58" panasonic plasma tv on ebay. I was pondering the $669.99 the seller was recommending for a warranty package from SquareTrade. When I noticed the "money back guarantee" on the ebay site, Decided to checked google, found this ebay site and can see now that "SquareTrade" is an organized crimminal company who bilks citizen's out of their hard earned money. Sure send me lots of $$$ and if you have a problem and want it back in a year or two "just ask, and ask and ask" by then we'll have made $millions$ on interest payments. Yes yes this is america and there is a "sucker born every nanosecond.
Ebay has been going down a slippery slope. Maybe that's why there is talk that they are trying to buy into Craigslist. Thank you people again for showing the real american pride. It's caring citizens.

A bought a square trade warranty for a Palm pilot. It, of course, broke and they called me to say that it was sold "as is" and they will refund the cost of the warranty. Square trade is a rip off!

The listing in question states that the item was used, and being sold "As-Is".

Under our previous Warranty Administrator, "As Is" items were considered ineligible for coverage.

Generally speaking, we identify eligible items by the item category, as well as the item description fields (Make, Model, Features, Condition) provided by eBay.

This item was described as being in "Used" condition, making it eligible for coverage. However, the portion of text indicating that the item was being sold "As Is" was included in what appears to be a seller template, uploaded into the item description section - this section is not readable by the mechanism we utilize to post our "Warranty Available" icon.

From what you have described, when you contacted us regarding your item, we reviewed the listing, determined that the item was ineligible and offered a full refund of the warranty purchase price.
