On Feb 6. i purchased an item from seller lu_cytime208 in China. 5 weeks gone by the item never showed up so they offtered a resend, i waited for another month and still no item. so i requested refund.

they told me they couldn't do that because "it pasted time"

so there is nothing i can do about it right?

I have the similar problem. Now I will buy new, the cheapest, item from the seller. Then will remind him for the previous purchase and will threaten with repotting him as cheater to Ebay and with very negative feedback. You can also try this. You can lose few dollars, but can receive your money back, or at least make his cheating harder.

Bought a 16gb memory card from a seller that goes by the name of gbp-seller. Recieved it in the mail a few weeks later and it was cracked in half. I contacted the seller about the cards and provided pictures and receipt and they said they would refund me but kept stalling and stalling with emails so ebay protection would not do anything. Now it's past the dead line.

Like others here, I lost money (nearly $1,000) due to an Ebay seller who said he was filing a claim for postal damages for an item I bought, but never followed through.  The Post Office moves very slow on claims, so I waiting -- thinking "why file a dispute with Ebay when this guy is working on the Postal claim?" 

Lesson learned: File a complaint ANYWAY.  If the money comes through, then cancel the complaint.  You will need the backup! 

And try this: Do a Google search on this seller's name, MARIO RICCA, and you won't believe all the complaints that have been filed online (all too late, like me, to get any help from Ebay's "45 day" limit due to this clown stringing people along). And yet, Ebay leaves him untouched...

Note to Ebay: If you want to clean up your act, do the Google search listed above and see if you still want to keep this guy active.

Can someone help me please.  I purchase an item off ebay and I never recevie the item the seller string me along until the 45 days have pass I then contacted ebay and they directed me to paypal.

Paypal is telling me since the 45 days have pass they cannot do anything to help me, I made my purchase 23 April 2012 . The 60 days have pass and I cannot leave any feedback.  I am new to ebay.

The item was completely broken because was very poor package. Promised to ship another one or refund after insurance is approved.... a lot of lies and 5 months later, still no refund nor replacemnet and I am on the same boat, can't complain on ebay or leave feedback.

Don' t buy from EBEST.2010! I have had the same problem. I purchased a sat nav from ebest.2010 from Hong kong, and the item was faulty. I returned the item and paid for a high postage from UK. Not having any problem before, I was naively feeling secure when buying on ebay. The conversation with ebest.2010 was very lengthy, their company was just dragging it and and it was too late when I realized I wouldn't get any money back. Of course, ebay couldn't do anything about it as it was beyond their period, it was also too late to write a negative comment. Therefore, if you buy anything from ebest.2010, they will take any opportunity to rip you off and simply don't expect to get your money back if anything happens. Stealing far in China, they feel safe doing so.

same here. but less money. he sent, it didn't come, he promised to resend it and now he is not answering. Next time, when it passes 30 days, i'm opening cases.. this is bad . ebay should have cases for 4 years . He stole from me and 1384 more people.

I purchased an Precor Elliptical 100i through Kevin with bricknutsales on ebay.  Kevin offers a 1 year warranty on all Parts, Labor and Frame. 

Interestingly, no refurbished item arrives within 45 days.  Once an item does arrive, if you pay to have it installed (which I did as it weighed 450 pounds) it took over 2 weeks and many emails to get folks out to do the job.

Right there I am over 45 day limit.  Why ebay does not have different rules for their sellers that cannot get a product to you in under 45 days makes no sense.

The machine worked great for 2 weeks and so I did give positive feedback.  Honestly, with a 1 year warranty I was not concerned about giving positive feedback so early.  Then everything started going downhill.  Long story short, I've been attempting to get a hold of bricknutsales on ebay, Kevin, and he has not responded in over 3 weeks. 

I went through ProPay and they have been great, but they admit they are not sure if they can do anything since they represent sellers only.  However, if anything I hope this makes them aware of their seller and they notify ebay.  I will follow up with my CC company next and continue to pursue additional avenues.

If you Google bricknutsales his godaddy listing comes up.  Interestingly, the phone number (213) 799.0919 is now routed to another number.  No more Kevin.
